Deed Book E 1859-1867 Page 97 Georgia Marion County This Indenture made this fifth day of June in the Year of Our Lord One Thousand Eight Hundred and Sixty between Leander F. McLaughlin of the County of Meriwether and said State of the first part and Joshua Brooks and Emanuel Finley of the County of Meriwether and State aforesaid of the second part. Witnesseth that the said Leander F. McLaughlin for and in consideration of the sum of Ten dollars to him in hand paid by the said Joshua Brooks and Emanuel Finley as well as the securing the payment of the note hereinafter described has granted, sold, aliened and conveyed by these presents doth grant, sell, alien and convey unto the said Joshua Brooks and Emanuel Finley their heirs and assigns Eight lots of land each containing Two Hundred Two and a Half acres more or less said lots of land lying in the Tenth district of originally Muscogee County now Marion County and known in the plan of said district as lots number (135) One Hundred Thirty Five, (133) One Hundred Thirty Three, (138) One Hundred Thirty Eight, (103) One Hundred Three, (105) One Hundred Five, (106) One Hundred Six, (107) One Hundred Seven and (100) One Hundred of said district and county. To have and to hold the said lots of land to the said Joshua Brooks and Emanuel Finley, their heirs and assigns in fee simple. And the said Leander F. McLaughlin, his heirs, executors and administrators shall the aforegranted premises to the Joshua Brooks and Emanuel Finley, their heirs, executors and administrators and assigns forever warrant and defend by virtue of these presents provided nevertheless that if the said Leander F. McLaughlin his heirs, executors or administrators shall fully pay off and discharge a certain promissory note made by him and said Joshua Brooks and Emanuel Finley Securities on the 22nd day of May last past, payable to James Neal or Bearer for the sum of Thirty Three Hundred Dollars due the 25th of January next and shall entirely absolve and same harmless the said Joshua Brooks and Emanuel Finley from all liability whatever on account of becoming security on said notes this Indenture to be void else to remain in full force.
