Eighteen hundred and sixty two, between James Moon, Sr. of the County of Schley of the first part, and Barnabus Hart of the County of Marion of the second part, all of said state. Witnesseth? that he said James Moon Senior hath this day made and delivered to Barnabus Hart, his certain promissory note. Subscribed with his handleaving ? even date with these present. Whereby the said James Moon, Sr. hath promised to pay said Barnabus Hart or bearer, Three Thousand nine hundred and sixty eight dollars and sixty one cents on or before the twenty fifth day of December next ensuing the date thereof for value received. Now for and in consideration of the sum of Five Dollars by the said Barnabus Hart to the said James Moon, Sr. cash in hand paid at and before the Sealing and delivery of these presents Page 322 the receipt whereof is hereby acknowledged, as well as for the letter securing the payment of the aforesaid, promissory note, the said James Moon, Sr. hath granted, bargained and sold, and by this presents do grant, bargain and sell unto the said Barnabus Hart his heirs and assigns, Six Hundred acres of land situated, lying and being in the (3) third District of Originally Muscogee, now Schley County, the numbers not known, but known as the Settlement of land on which the said James Moon, Sr. now resides, with all the rights, members and appurtences to the paid land in any wise appertaining or belonging, and also three Negroes to wit; Jack, a man about twenty two years old, Green, a man about twenty years old and George a man about twenty five years old. To have and to hold said bargained land & Negroes to him the said Barnabus Hart, his heirs & assigns, to his & their own right and proper use, benefit and school forever. And the said James Moon. Sr. for himself his heirs, executors and Administrators will warrant and forever defend the right and title to the above described land and negroes, unto the said Barnabus Hart against the claim of himself and heirs and against the claims of all other persons whatsoever. Provided nevertheless, that if said James Moon, Sr. his heirs executors and administrators shall well and truly pay or cause to be paid unto the said Barnabus Hart, his heirs and assigns the aforementioned sum of three thousand nine hundred and sixty eight dollars and sixty one cents on the day and time mentioned and appointed for the payment thereof in the said promissory note mentioned with lawful interest on the same according to the tenor of said note, then and from henceforth, as well this present indenture and the right to the property thereby conveyed as said promissory note shall cease determine and be void to all intents and purposes.
