All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Angela Covington aangel4ken@windstream.net January 22, 2007, 9:39 am Lot 88/30th Written: January 25, 1849 Recorded: March 12, 1849 Georgia Marion County This indenture or conveyance witnepeth that Wells Smith for and in consideration of the sum of eight hundred dollars to him in hand paid at & before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath this day granted bargained sold and conveyed and by these presents do grant bargain sell and convey unto Wm A Black of the County and State aforesaid the following described lot or tract of land situated lying and being in the thirtieth district of originally Lee now Marion County and known and distinguished in the plan of said district and county as lot no 88, eighty-eight, containing two hundred two and one half acres more or less. To have and to hold said tract or parcel of land to him the said Wm A Black his heirs and apigns forever in fee simple. The condition of the above indenture or conveyance is such that? the said Wells Smith hath this day made his three certain instruments in writing commonly called promissory notes, a true copy of which are hereunto annexed now should the said Wells Smith will and trul pay off and discharge the said notes whenever they shall become due according to their ? & effect and shall at all times save harmly? and indemnify the said Wm A Black and his heirs and apigns from all liability and subsequent ? by reason of the non payment of said notes then this instrument to be void and of non effect or else to reamin in full force and virtue. Copy of notes $266.oo on the 25th Dec 1849 I promis to pay Wm Piclher Sr or bearer two hundred & sixty-six dollars value rec'd and if suit has to be had on this note then it to draw interest from date signed Jany 25th 1849 Wells Smith Wm A Black, secty $266.00 on 25th Dec 1850 I promise to pay Wm Pilcher Sr or bearer two hundred & sixty six dollars value rec'd and if suit has to be had on this note then it to draw interest from date signed Jany 25th 1849 Wells Smith Wm A Black, secty $266.00 in the 25th Dec 1851 I promise to pay Wm Piclher St or bearer two hundred & sixty-six dollars value rec'd and if suit has to be had on this note then it to draw interest from date signed Jany 25th 1849 Wells Smith Wm A Black, secty There being three notes each for two hundred sixty-six dollars the forgoing which are true copies.
