All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: angela covington aangel4ken@alltel.net November 25, 2006, 5:53 pm Land lot 34 Written: August 4, 1922 Recorded: August 5, 1922 State of Georgia County of Marion THIS AGREEMENT, made this 4th day of August 1922, by and between John Williams, party of the first part and Alexander & Bland of Stewart County parties of the second part, WITNESSETH: That the said party of the first part in consideration of the sum of Three Hundred Thirty Five dollars ($335.00) to him in hand paid, the receipt of which is hereby acknowledged, and in further consideration of the payments and agreements hereinafter mentione and contained, hath bargained, sold and conveyed and by these presents does bargain, sell, and convey unto the said Alexander and Bland and assigns, all of the Merchantable Pine Timber, of the kind and size herinafter mentioned, upon the tract of land situated in 51st Land District of Marion County, State of Georgia, adjoining the lands of W. W. Tyler and others and more fully described to wit: The South-half of lot of land number Thirty four (34) containing 101-1/4 acres, more or less, also Fifteen (15)acres of the South-west corner of the North-half of said lot number Thirty-four (34), cut off by a line well marked out, same lying between the East End of the South half of lot number (31) Thirty one, being all that portion of said lot lying and being South of Fox Creek and East of Sait Mary's Road; Also Forty (40) acres of uniform width off the west end of the South half of lot number Sixty three (63) cut off from the blance of said lot by a line well marked out; all aggregating 166 1/4 acres, more or less' all of said herein covered except five (5) acres in south east corner of the 40 acre tract of lot number Sixty three (63) is herby excepted. Together with the full rights and privileges for and during the period of five years from the date hereof by officers, agents, servants, and employees. (1) enter upon said lands, and pass and re-pass over the same at will on foot or with teams and conveyances, (2) to out and remove said timber and to construct and operate any roads over and upon said lands as the parties of the second part heirs, successors, and assigns may deem necessary for outting and removing the timber above conveyed. (3) to use and operate any road that the parties of the second part heirs, successors, and assigns, may construct upon and over the land so long as they may desire either for removal of said timber, or for any other purpose contemplated by this agreement; (4) to erect , construct or operate saw-mills, planing mills, and such other machinery as they may deem necessary to manufacture said timber into lumber or any other wood product adn to use waters upon said lands, dig wells or convey water over or through said lands, the purpose of operating said mills or machinery; (5) to use the said lands and roads for the purpose of removing the product of said mills or machinery from the said land; (6) to pile, pack, stack, or store the lumber cut of manufactured upon said land ton said land; (7) to erect such buildings upon said land as may be necessary to carry on the operation herein contemplated; and it is hereby agreed and stipulated that to carry on the operation herein contemplated' and it is hereby agreed and stipulated that the title to the logs, lumber, saw mills, planing mills, machinery of every description, houses erected upon said lands, and everything else placed upon said land by the said parties of the second part, heirs, successors, and assigns shall be and remain in the possession of the said parties of the second part, heirs, successors, assigns, and the said property shall all be removed from said land or sold or otherwise disposed of at the termination of this contract, as may be deemed best by the said parties of the second part, heirs, successors, and assigns. The manner of payments and kinds and sizes of timber embraced in this contract of conveyance as follows: All of the Merchantable timber on said lands "Pine Timber", except the timber on five acres in the South-east corber of the 40 acre tract of lot number sixty three (63) is hereby excepted. It is understood and agreed between the parties that, upon the expiration of the time allowed herein the parties of the second part to complete the outting of the timber and the various acts incident thereto named herin the parties of the second part may, at election continue this contract of full force and for a term of 5 years by tending to the party of the first part, at the date of expiration or within thirty days thereafter, the sume ewual to 8 percent interest on the cinsideration herein named, for the first year of said renewal, and annually thereafter a similar sum during the time of said renewal. Said payment to be tenered annually and the parties of the second part to have the right to terminate said contract at any time by thirty days notice or by failure to make such tender. In Witness Whereof, the said party of the first part hath hereunto set his hand and affixed his seal the day and year forst above written. H. Cosby, do hereby release all my right, title, and interest in the timber on the lands described in the within lease to Alexander and Bland.
