ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF GEORGIA, PASSED IN NOVEMBER AND DECEMBER, 1837. ACADEMIES. 1837 Vol. 1 -- Page: 12 Sequential Number: 005 Full Title: AN ACT to Incorporate and appoint Trustees for the Tazewell Academy, in the county of Marion. Section 1. Be it enacted by the Senate and House of Representatives of the State of Georgia in General Assembly met, and it is hereby enacted by the authority aforesaid, That Burton W. Dowd, James Powers, Joseph J. Battle, Robert S. Burch, and C. B. Strange, and their successors in office, be, and they are hereby appointed Trustees for the Tazewell Academy, in the County of Marion. Sec. 2. And be it further enacted, That the said Trustees, and their successors in office, be, and they are hereby declared to be a body politic and corporate, by the name and style of the Trustees of Tazewell Academy, and as such, shall be capable and liable of sueing and being sued, pleading and being impleaded, and shall be authorized to make such by-laws and regulations as may be necessary for the government of said Academy: Provided, such by-laws are not repugnant to the Constitution or Laws of this State, and for that purpose, may have and use a common seal, and appoint such officers as they may think proper, and remove the same from office. Sec. 3. And be it further enacted, That the said Trustees of the said Academy shall be capable of accepting and being invested with all manner of property, both real and personal, all gifts, donations, grants, rights, privileges, and immunities whatsoever, which may belong to the said Institution, or which may hereafter be conveyed or transferred to them -------------------------------------------------------------------------------- Page: 13 and their successors in office, to have and to hold the same, for the proper benefit and behoof of the said Academy. Sec. 4. And be it further enacted, That when any vacancy shall happen, by death, resignation, or otherwise, of any one or more of the Trustees of said Academy, their survivors, or a majority of them shall fill such vacancy.
