I Barnabus Hart being feeble in body but of sound mind and disp...mind and memory do make and publish and declare this to be my last Will & Testament hereby revoking all other will by me heretofore made and I publish and declare this to be my last Will & Testament. I commit my soul to God who gave it hoping that when I shall have left this township of clay that he will take it home to Heaven to rest my body. I desire , wish..decently buried. As to what little property I have ( left) remaining I dispose of in the following manner. My just debts I wish then the balance of my property of whatever it may consist that I may die possessed of, I give and devise to my son Barnabus hart to him and to his heir forever on the condition that he shall take me and my wife, Gellie and provide for us and take care of us during our natural lives. In conclusion of the foregoing I nominate and appoint my said son, Barnabus Hart Executor to this my last Will and Testament. Witness my hand and Seal this 19th day of February 1873 Barnabus Hart ( LS) Form of law of the Will of Barnabus Hart late of said county deceased. Barnabus Hart the Executor has propounded for Probate in common form of law a paper purporting to be the last Will and Testament of Barnabus Hart dec'd late of said county, and having offered James Russell as a witness who being duly sworn says that said Barnabus Hart signed sealed published and declared the said paper now offered for Probate as his last Will and Testament in his presence and in the presence of James Bigham and Wm. A. Black and that they together with said Bigham and Black signed said Will in the presence of Testator and of each other who signed it at the request of said Testator and that Testator signed said Will of his own accord and at the time of the signing he believed him to be of sound mind.
