Nutt State of Georgia, Marion County: Know all men by these present that I William B. Nutt of the County and State aforsaid being of sound mind and memory but bring suffering under intense durese and fearing that I may be called on to leave the ??? do make constit? and ordain this writing as my last will and testament ? dospose of all my earthly posesious? in the manner following hereby revoking all other wills by me heretofore made. Item First- It is my will and desire that all my just debts be paid as soon after my deat as convenient. Item Second- It is my will and desire that all of my property real personal or mixed and all my eartly possious be kept together in the hands of my Executrix and worked and managed by her as long as she remains in widowhood and the children remain in this minority, but if she shoul marry again, then it is my will and desire that all of my Estate and property of every discription be equally distributed or divided among all my children and wife. share and share alike to each one. Item Third- If my beloved wife should continue in widowhood until one of my children becomes twenty one years of age or until one of daughters marrys then it is my will and desire that my Executrix shall set off and pay over? to said heir the propper distributive share that is due to him or her still retaining the balance in her hands and managing the ????? until an other becomes competant by age or marriage to receive his or her share which shall in like manner be paid over as before mentioned and continue on in this manner until the last one shall receive his or her share, but in case my beloved wife should marry again at any time previous to paying over the last remaining heir, its distributive share then a division of the balanceof the property shall be directly made. Item Fourth- I do hereby nominate and appoint my beloved wife - Mary Jane Nutt as my executrix to execute and carry into effect this my last will and testament In testimoney where of the said Wm B. Nutt has hereunto set his name and affixed his seal this the twenty eight th day of November 1872 William B. Nutt, Exsarte?: In the matter of the probate in common form of law of Will of W. B. Nutt in Marion Court of Ordinary December Term 1872 Whereas the last Will and Testament of Wm B. Nutt has been propornded for Probate in Common Form of law by Mary J. Nutt the Executrix twice named and Cicero W. Epps one of the subscribing witnesses is being sworn says that Wm B. Nutt signed dealed published and declared the paper offered in Court as his last Will and Testament and that said testator was of sound mind at the time of the Execution of the same and that he signed the same in the presence of witness and of the subscribing witneses and that all the witneses signed the same in the presence of testator and of each other at the request of tesator. Wherefore it is ordered and adjudged that the paper be acclaimed to be the last will of said Wm B. Nutt and that the same be probated in common form of law and admitted to record as such. Jas. M.
