Wills, Book A 1846-1915 Powell, William: May 17,1851. August 9, 1852. To wife, Nancy Powell, the following property to wit. (viz), the plantation whereon I now live and the plantation called the Armour place, also the land lying on west side of public road between my house and a spring called the School-house Spring altogether comprising about 425 acres; also, the following negroes: Caboon, Lewis, Tom, Frank, Allen, Harris, Dock, Unity, charlotte, Sophia, Malinda, and Lucinda and her two children with their future increase; also three choice mules, 1 bay horse, six cows and calves, one yoke oxen and cart, five sows and pigs, 30 shoats, my Barouck, one years support in provisions, and $200, all household and kitchen furniture. To sister-in-law, Sally Edwards, she to be supported out of proceeds of above property and if she to survive my wife then my Executors are to apportion her a sufficiency out of the above property for support as long as she may live single. Support to cease if she marry. Wife, Nancy Powell, to have control of above property during her life and at her death, the property to revert to the estate to be equally divided among my children with exception of that portion that may be apportioned to Salley W. Edwards. Direct my Executors to purchase the lot of land belonging to estate of John Simmons deceased late of Marion County. Son, Josiah C. Powell, to take possession of said land, live upon and cultivate the land free of charge or rent so long as my wife Nancy Powell may live. After the death of my wife, land to revert to my estate. To M.J. Bivens in special trust for my two grandchildren, Mary Ann and Martha Bivens $600. Remaining negro property to be divided among my children and grandchildren: son, James L. Powell, son, Samuel J. Powell, son Josiah C. Powell, son-in-law, Augustus H. Finley in special trust for my grandchildren William P. Finley, Mary A. Finley, Benjamin F. Finley, Frances M. Finley, Henry H. Finley, Josiah C. Finley, John M. Finley, Augustus C. Finley. To son-in-law Martin Luther Biven in special trust for grandchildren Mary Ann and Martha Biven to be equally divided between them when they marry or arrive at age 21. An equal part to son-in-law Thomas A. Wall in special trust for his wife and children. An equal share to my daughter Emeline Frasier as Trustee for her children with exception of one equal share to be paid to my grandson William P. Frasier. Remainder of property to be sold to highest bidder on credit of 12 months and proceeds to be equally divided among my children and grandchildren. All property that may revert back to estate at death of my wife to be equally divided among my children or sons-in-law. Executors: son, Josiah C. Powell and son-in-law, Martin L. Bivens.
