Blythe of said state and county being of advanced age and knowing that I must shortly depart this life deem it right and proper both as respects my family and myself that I make a disposition of the property with which a kind providence has blessed me, do therefore make this my last will and testament hereby revoking all others heretofore made by me. 1st Item I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstance in life. 2nd Item I desire and direct that all my just debts be paid without delay by my executor hereinafter named and appointed as I am unwilling my creditors should be delayed to their rights especially as there is no necessity for delay. 3rd Item I give bequeath devise to beloved wife and my daughter Orra and Martha, One Hundred and Forty acres of lot of land no. Sixty Nine (69) also One Hundred acres of the west side of lot of land no. (92) Ninety Two, said described land lying and being in the (4th) Fourth District of Marion County to have and to hold for and during their natural lives to share and share alike and in the event that my daughter Orra should marry then at the death of my wife said described lands to be sold and equally divided between all of my lawful heirs the bequest made to my wife or in lieu of her whole dower, also all of my household and kitchen furniture to have and hold for and during their natural lives and at their deaths to be equally divided between the rest of the heirs also one milk cow to be selected by them. 4th Item It is my desire that at my death that all my property both real and personal be sold and equally divided between all my lawful heirs – my beloved wife Martha and all of my children to wit: Orra, George, Malinda Lumpkin, John, Sam, Willie, Ada Rush. 5th Item I desire that after my death that enough of the proceeds of my proper sales be used to wire in my lot at the cemetery at New Providence Church. 6th Item I hereby constitute and appoint my beloved son George A. Blythe executor to this my last will and testament this 29th day of June 1910. James M. (his mark) Blythe Signed sealed declared and published by J.M. Blythe as his last will and testament in the presence of us the subscribers hereto in the presence of said testator at his special instance and request and of each other this June 29th 1910. W.P. Blythe sign and publish the within attached paper as his last will and testament; that he subscribed the same as witness thereto at the special instance and request of the said Jas. M. Blythe and in his presence as did also V.E. Helms & R.G. Noell in the presence of the testator and of each other that the said Jas. M. Blythe signed the same freely and voluntarily and was at the time of such signing of sound and disposing mind and memory. W.P.
