Ivey (Record transferred from Richmond County) In the name of God Amen!! I, James A. Ivey of the City of Augusta, in the County of Richmond, and State of Georgia, being of sound mind and memory and considering the uncertainty of life, do therefore, make, ordain, publish and declare this to be my last Will and Testament; that is to say: First: After all my lawful debts are paid and discharged, the residue of my Estate, real and personal, I give, bequeath, and dispose of as follows, to wit: First: To my wife, Martha Frances Ivey, I bequeath the whole of my property, both real and personal, for her to manage and to have during the term of her natural life. It is my wish for her to educate our children out of it, and to divide it out amongst them, as they become of age, to suit herself and as she thinks best. I also wish my nephew Charles Edward Cash, to share equally, as my own children of the property. In the event of my wife marrying again, I wish my property divide equally, and for her to have a child's part of it, and at her death, the property which I leave her is to go back to my children to be equally divided among them. My mother, Mary Ivey, is to have a support out of my property, as long as she lives and is to live on my place. I also give to my brother, Thomas Ivey, a home on my place, known as the Sweeny place, for him to live at and do as he pleases with, so long as he gives to my wife and heirs, one sixth of the grain and cotton crop, which he may raise and gather on said place, and one fifth of the proceeds of all wood and lumber sold off of said tract of land. I also give to my brother, John T. Ivey, a home on my place, known as the Zachery tract, for him to live at and do as he pleases with, so long as he gives to my wife and heirs one sixth of the grain and cotton crop which may be gathered on the place; and one fifth of the proceeds of all wood and lumber which may be sold off of said tract of land. Both of the above tracts of land are situated in Columbia County, State of Georgia. I also give my brother John T. Ivey the privilege of cutting wood off of my tract of land, which my brother Thomas Ivey will live on, known as the Sweeny place, so long as he gives to my wife and heirs one fifth of the proceeds of all wood and lumber which may be sold off of said tract by him. Likewise I make, constitute and appoint my wife, Martha Frances Ivey, Executrix of this my last Will and Testament, hereby revoking all former Wills by me made. In Witness Whereof, I have hereunto subscribed my name and affixed my seal, this the twenty third day of January, in the year of our Lord, One Thousand Eight Hundred and Sixty-four. James A.
