Wallace that has been transcribed from copy from the McIntosh County Courthouse. In the name of God Amen I Martha D. Wallace, widow of the State of Georgia and County of McIntosh being in feeble health of body but in perfect mind and memory taking into consideration that it is appointed for all men to die do name and ordained this my last will and testament Recommending my soul in to the hands of almighty God who gave it and my body to the dust to be buried in a decent Christian burial at the direction of my executor then: My will and desire is that after my death, all my just debts be paid. Item: I give and bequeath to my son John Deverges one cow and calf. Item: I give and bequeath to each of the sons of James Deverges one cow and one calf: that is four cows and four calf’s for the following four sons of the late James Deverges deceased. Said cows and calves to be selected and pointed out by my son William J. Wallace. Item: Give and bequeath to my son William J. Wallace and my friend James J. Garrison that for the children of my late son Thomas Wallace deceased, one half of my stock of cattle. Item: I give and bequeath to my son William J. Wallace the other or one half of my stock of cattle, that is to say my stock of cattle to be divided equally between William J Wallace who is to have half and the joint heirs of Thomas Wallace to have the other half. Item: I give and bequeath to my grand daughter Mary Margaret Thomas Wallace daughter of William Wallace one Negro girl child named Caroline Cecilia together with her future issues and increases. Item: My will and desire is that all my Negroes except the one named above) Vize, Paul, Hetty, Charles, Catherine, Victor, Edward, Saul, Dennis and Joseph with all the future issue and increase of the families be divided into four equal parts and that one part or fourth go and be given to my son William J Wallace in trust for his own children which he now has or may hereafter have and that one fourth part go and be given to William J Wallace and James J Garrison in trust for the use and benefit of my grand children to wit: Ester Wallace and Eliza and James William Wallace and Orlando Wallace they being the children of my late son Thomas Wallace deceased and one fourth part go and be given to William J Wallace and James J Garrison in trust for my daughter Martha Young during her natural life and at the death of said Martha Young to go and be given to her children but should the said Martha Young die bearing a child or children under twenty one years of age said property to be kept by William J Wallace and James J Garrison in trust for them until they arrive at twenty one years of age and one fourth part to go and be given to said William J Wallace and J J Garrison in trust for my daughter Caroline Young during her natural life and at her death for her children until they arrived at the age of twenty one years. Item: I give and bequeath to my son William J Wallace, the tract of land which I know live on containing one hundred and twenty six acres more or less with all the appurtenances thereto. Item: I give and bequeath to my daughter Caroline Young one feather bed. To my son William J Wallace one wool mattress and to my grand daughter Mary Esther Wallace one wool mattress to my grand daughter Mary M.H. Wallace I give one half dozen silver tablespoons and to my grand son James Troup Wallace one half dozen silver tea spoons and to Mary Esther Wallace I give one half dozen silver teaspoons and to my son William J Wallace I give all my remaining house hold and kitchen furniture and all and every other property that I may be possessed of at the time of my death not already specified. Item: I hereby nominate constitute and appoint my son William J Wallace and my friend James J Garrison my executors and I do hereby disallow, revoke, and disannul all former testaments wills I gave and bequeath and executors by me in any wise before named, willed or bequeathed notifying and confirming this and no other as my last will and testament In testimony whereof I have hereunto set my hand this fifth day of April in the year of our Lord Eighteen Hundred and fifty three The words and Orlando Wallace in the fourth line on the second page intended before signing Signed and Acknowledged In the presence of John Forbes her James McDonald Martha D X Wallace William J King, Sr. mark State of Georgia : McIntosh County : Ordinary Office Darien September 18th 1854 I do hereby certify the fourgoing To be a true and correct copy of the last will and Testament of Martha D. Wallace deceased now Of record in this office Armand Lefilo CK ===================== Probate Records This is transcribed from the inventory and appraisement of slaves belonging to Martha D. Wallace, after her death. Inventory and appraisement and division of the Estate of the late Martha D. Wallace deceased among the legatees of the said Martha D. Wallace Deceased. Paul $500 Charles 800 Victor 600 Paul Dennis 300 Hetty 500 Catherine 600 Joseph 200 Shadric 100 $3,600 Georgia—- McIntosh County. We do certify upon oath that as far as was produced to us, by the executor the above and foregoing contains a true appraisement of the Negroes of the estate of the late Martha D. Wallace and for the purpose of a division among the legatees we put Paul and Hetty on lot no. 1 which was drawn by Mrs. Martha Young. And Charles and Shadrac in lot no. 2 which was drawn by Mrs. Caroline C. Young and Paul Dennis in lot no. 3 and which was drawn by Mrs. Mary Ann Wallace, and Victor and Joseph on lot no. 4 which was drawn by William J Wallace. Lot no. 1 being worth one thousand dollars and lot no. 4 only eight hundred. Lot no. 1 will have to pay lot no. 4 one hundred dollars. Signed Wm. T. King 17th March 1855 E.W. Delegal Sworn Appraisers Daniel McDonald I do certify that the within appraisers were sworn to appraise and divide the Negroes of the Estate of Martha D. DeLorme, Ordinary of the said county whereby certify that the above and foregoing appraisement and division is a true and perfect copy of the original appraisement and division now on record in my office. Witnessed my hand & seal of office Ache. A. DeLorme Ordinary Note: The Ordinary certifies that this is a perfect copy as of record in his office. Notice that the slave Catherine is not mentioned in the division, but apparently she was in lot no. 3 which was drawn by Mary Ann Wallace. Also note that the Moses Young, JP, signing these papers is the husband of Martha Young, one of the heirs.
