Boyd of Meriwether County, Georgia APPLICATION FOR LETTERS OF ADMINISTRATION Meriwether County Georgia Probate Court August Term, 1857 Minute Book 3, page 80 August 3, 1857 Whereas Martha Boyd and Benjamin H. White having made application in due form of law to this court for letters of administration on the Estate of Robert H. Boyd late of said county dec’d, & whereas it appears that said applicants prefer giving their separate bonds & security and the same being acquiesced in by the court Whereupon the said applicants having each taken the oath as required by law and Martha Boyd on her part entered into bond in the sum of fifteen thousand dollars with her John Horn, Drewry M. Allen and Robert McCrary all of said county as securities on her part And the said Benjamin H. White having also entered into bond on his part in the sum of fifteen thousand dollars with James C. Allen, Stoddard C. Powell and McDuffie Boyd as his securities in said bond. It is therefore ordered by the court that letters of administration issue to the said Martha Boyd and Benjamin H. White and that their names be entered on the dockett of this court as such Administratrix & Administrator And that Carser (?) W. Williams, Robt. McCrary, H.S. [or G.] Sullivan George W. Milner and John S. Tidwell be and they are hereby appointed as the appraisers of the estate of said Dec’d. D.C. Allen, Stoddard C. Powell & McDuffie Boyd Securities are held and firmly bound unto Davis C. Gresham Ordinary in and for said county, and his successors in office in the just and full sum of fifteen thousand dollars for the payment of which sum to the said Ordinary and his successors in office, we bind ourselves, our heirs, executors and administrators in the whole and for the whole sum jointly, and severally – firmly by these presents sealed with our seals and dates this third day of August 1857. The condition of the above obligation is such, That if the above bound Benj. H. White who has this day been appointed administrator of the goods, chattels and credits of Robert H. Boyd, late of Meriwether County, deceased, which have or shall come into the hands, possession or knowledge of the said Benjamin H. White the administrator aforesaid or the hands or possession of any person or persons for him and the same so made, do exhibit to the said Ordinary when he shall be thereunto required, and such goods, chattels and credits do well and truly administer according to law, and do make a just and true account of his actions and doings therein when he shall thereunto be legally required. And all the goods, chattels and credits, which shall be found remaining upon the account of the said administration, the same being first allowed by the said Ordinary, shall deliver and pay to such persons respectively, as may be entitled to the same by law. And if it shall appear hereafter that any last Will and Testament was made by the deceased, and the same be proven before the said Ordinary, and the Executor obtain a certificate of the probate thereof, and said Administrator in such case, if required, render and deliver up the said letters of Administration, then this obligation to be void, else to remain in full force. Allen (Seal) Robert McCrary (Seal) PETITION FOR TWELVE MONTHS SUPPORT Meriwether County, Georgia probate Court Minute Book 3, page 84 7 September 1857 Whereas Martha Boyd the Administratrix of the estate of Robert H. Boyd late of said county dec’d having petitioned this court to appoint persons to set a part twelve months support out of the Estate of said dec’d for the widow of said dec’d. Therefore ordered by the Court that Robert McCrary, Geo. W. Milner James B. Glass Sutley (?) Rogers and William Hodnett be and they are hereby appointed to assess a twelve months support out of the Estate of Robt. H. Boyd late of said County dec’d for the widow of said as contemplated and provided for by law. D.C. Gresham OMC LEAVE TO SELL Meriwether County, Georgia Probate Court Minute Book 3, page 89 November Term 1857 Whereas Sarah Boyd Administratrix, and Benjamin H. White, Administrator on the Estate of Robert H. Boyd late of said County deceased, having made application in due form of Law to this Court, by publication in the Banner and Sentinel a Public Gazette of this State, published in Newnan, Georgia, for two months previous to this term of the Court for leave to sell the Land and Negroes belonging to the Estate of said deceased and for the purpose of a division of the same among the heirs of said deceased. And it appearing to the satisfaction of the Court that a just and equitable division of said Land and Negroes cannot be made without the same be sold. It is therefore ordered by the Court that Sarah Boyd, Administratrix and Benjamin H. White Administrator as aforesaid have leave and be allowed to sell said lands and Negroes in terms of the Laws most advantageous to said Estate and for the purpose of a division of the same among the heirs of said deceased. D.C. Gresham OMC NOTES: No appraisal of the estate or estate sale has been found in any books in the Meriwether County probate office. Additional Comments: Robert H. Boyd was the son of Hugh and Jennett Boyd of Newberry Co., SC, and married Cloretta D. Gray, daughter of Frederick Gray and Cloretta Dawkins, in 1815, probably in Abbeville Co., S.C. Robert H. Boyd, born in 1791, first appeared in Meriwether in 1838 and purchased nearly 400 acres of land. This action came on the heels of the death of his father-in-law, Frederick Gray, in 1837 in Abbeville, SC. and the death of his brother, Matthew Boyd, in 1837 in Newberry Co., SC. Frederick left his daughter, Cloretta, and her husband, Robert Boyd, a portion of his sizeable estate. Matthew Boyd also left his brother a portion of his estate. Robert and his wife had six children, according to family Bible records: Frederick G. Boyd (1816-?); Mary E. Boyd (White) (1823-1848); William H.B. Boyd (1839-?); Julia Ann Boyd (White) (1831-?); Amanda M. Boyd (1833-1850); and McDuffee C. Boyd (1836-1922). The 1840 Meriwether County census shows three boys and two girls. One of those girls was Julia Boyd who married Benjamin H. White, the co-administrator of Robert’s estate. Julia and Benjamin moved from Meriwether sometime after 1860 and lived first in Milton County, GA (1870) and then in Polk Co., GA (1880). Children of Julia Boyd and Benjamin White who have been found in the censuses were Charles White (b. abt 1847), Robert B. White (b. abt 1856), Nora White (b. abt 1859), Benjamin White (b. abt 1862), Emmett White (b. abt 1864), Cloretta White (b. abt 1866) and Mary C. White (b. abt 1868). One of Robert’s known sons , McDuffie C. Boyd, appeared with him in the 1850 census. McDuffie C. Boyd married Amanda (Herndon) Brooks, widow of Matthew Brooks, in Coweta County in 1857. McDuffie and Amanda had moved to Carroll County by 1870 and to Polk County, GA by 1880. According to Amanda’s obit published in 1890 in Haralson County, they had six children, but only five are known: William Henry Boyd, b. 1859; Virginia A. Boyd (1862-?); Robert E. Boyd, b. 1866; Margaret E. Boyd, b. 1869); and Montie Tench (listed as Mardes or Marcus, name is unreadable in the census), b. 1874. Two of Robert H. Boyd’s other children with Cloretta, Frederick G. Boyd and William H. B. Boyd are mentioned in deeds with Robert Boyd and McDuffie Boyd in Meriwether County. Frederick G. Boyd married Elizabeth Irvin in Pike County in 1851 and appears in the 1860 Meriwether census with her, next door to his brother, McDuffie C. Boyd, and sister, Julia Boyd White. In 1870, Frederick is living with his brother, McDuffie Boyd, in Carroll County. His wife does not appear with him in this census. Robert H. Boyd married (second) Martha Wagner in Pike County in 1848. It appears they had no children, but a deed found in the Meriwether courthouse indicates some kind of pre-nuptial agreement, giving 100 acres of land in Meriwether to Ignatius Terrell as trustee. I am presently in the process of trying to read this deed which is faded very badly. Martha died before May of 1852, when Amanda B. Emfinger of Pike County applied for permission to administer her estate. Robert may have married a third time to Martha McCra in 1852, a marriage listed in the Meriwether County Marriage Book B, page 124. This may be the Martha shown above who, as the widow, applied for separate administrative privileges regarding Robert’s estate and also applied for 12 months support.
