One thousand eight hundred and fifty one by & between Robt. H. Boyd & his wife Martha Boyd of the county and state aforesaid of the first and second part & Ignatius Terrell of the County of Pike & state aforesaid of the other part. Whereas the said Robert H. Boyd & Martha Boyd were heretofore to wit on the twenty-eighth day of May A.D. Eighteen hundred and forty eight duly & legally married & before & since said marriage it was agreed between them that this settlement should be made. And whereas on said marriage the said Robert H. Boyd received in right & by virtue thereof considerable property from his said wife and whereas families by the improvidence or misfortunes of the Father of the family are often ---?--- to penury and want & to prevent such mishap it is deemed right to provide against the unforseen events of the future, And whereas the said Robert H. Boyd is at this time wholly and entirely free from debt, embarrassments or any with--?-- whatever & is possessed of considerable estate both real and personal in his own his (sic) right disencumbered of any debts contracts or demands whatever. Now for the purpose of complying with said agreement effecting the interest hereof This indenture Witnesseth that for and in consideration of the premises the said marriage & the aforesaid agreement and effecting the intent hereof. This indenture witnesseth that for and in consideration of the premises the said marriage and the Aforesaid agreement and for and in further consideration of the sum of ten dollars by the said Ignatius Terrell for the said Martha Boyd to the said Robert H. Boyd cash in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby duly acknowledged, the said Robert H. Boyd hath given granted bargained sold conveyed and settled and doth by these presents give grant bargain sell convey and settle to and upon the said Ignatius Terrell & his successors as the Trustee or Trustees of & for the said Martha Boyd for her sole and separate use free from the future debts or contracts of her present or any future husband the following property to wit: One hundred acres more or less it being the North part of Lot number two hundred & twenty seven in the upper ninth district of said Meriwether County being the one hundred acres of land in which my dwelling house now stands & one house(?) worth sixty dollars, one cow & calf & sow& pigs & all my household & kitchen furniture with all and singular the houses tennements me---?-- rights members & appurtenances ---?--- belonging or in any wise appearing. To have & to hold the same for & during my life then to carry the same in fee simple to my said wife or her personal representatives in case she shall die before I do the same to remain in possession of my wife and myself for and during my life & after my death absolutely to vest in her or her personal representatives and I hereby consent for my said wife to dispose of said property & premises in any manner she may desire to do only so as not to take effect until after my death. Additional Comments: Additional information: (Mrs.) Martha T. Osborne Wagner Boyd (widow of Nicholas Wagner of Pike County) was Robert H. Boyd's second wife. His first wife was Chloeretta Gray Boyd who passed away 22 Jan. 1848. (Source: Family Bible records.) Robert had received inheritances from his father (1799), his brother (1835) and his father-in-law (1837) when he came to Meriwether County from Newberry Co., S.C. and made several land purchases beginning in 1838. He owned several hundred acres of land before he married Martha and purchased more afterward. Martha owned at least two lots and homes in Zebulon (Pike County). Martha died shortly after this contract was made and her estate was administered by her daughter, (Mrs.) Amanda B. (Wagner) Emfinger. There is no mention of Robert in her estate settlement, although he didn't die until 1857. The land placed in trust with Ignatius Terrell was mentioned in Martha's estate inventory but no value was assigned. According to wording in the inventory, an unknown value for the property was based on "...McD. Boyd's life estate ..." McDuffie Boyd was Robert's son and Martha's stepson.
