Witnesseth that the said Ransom Ray on the day & year aforesaid made & executed to the said Whitton Keith his Twelve certain promissory notes of Thirty Dollars each whereby by the 25th day of December thereafter he promised to the said Whitton Keith or bearer the said Twelve Promissory notes amounting to three hundred & sixty dollars value received and if not punctually paid Interest from date. And the said Ransom having on the day & year aforesaid made and executed with John Ray his certain other four promissory notes whereby by the 25th day of December next thereafter he promised to pay to the said Whitton Keith or bearer the said four notes amounting to one hundred & twenty dollars value received and if not punctually paid interest from date. Now for and in consideration of the sum of five dollars by the said Whitton Keith to the said Ransom Ray in hand paid the receipt whereof is hereby acknowledged as well as for the better securing the Payments of the said promissory notes (the whole of which being unpaid). The said Ransom Ray has granted bargained sold & conveyed and by these presents does grant bargain sell & convey unto the said Keith his heirs & assigns all that tract or parcel of land situate in the County of Troup originally now Meriwether Known as [sic] distinguished as one hundred and twenty five acres (being and [can’t read]) on the West side of lot one hundred & forty one in the Eleventh District of said County. To have and to hold the said land with all & singular the rights members and appurtenances thereof unto him the said Keith his heirs and assigns to his & their own use benefit & behoof forever in fee simple. And the said Ray his heirs & assigns will warrant & forever defend the right & title thereof against the claim of all and every person whatsoever. And also on the day & year aforesaid for the aforementioned consideration & for the better securing the payment of the aforesaid notes the said Ray hath granted bargained & sold & by These presents does grant bargain sell and convey unto the said Keith his heirs and assigns one negro to with Harriet a negro girl about eight years of age. To have and to hold the bargained property to the said Keith his heirs and assigns to his own proper use and benefit forever in fee simple. And the said Ray for himself his heirs and assigns the said bargained property unto the said Keith his heirs and assigns shall & will warrant & forever defend against the claim of all persons whatsoever. Provided Nevertheless that if the said Ray his heirs and assigns shall well and Truly Pay unto the said Keith by the twenty fifth day of December next the sum of four hundred and eighty dollars the aggregate amount of the aforesaid notes then and forever thence forth this indenture and conveyance and the right of property thereby Conveyed as well as the said promissory notes shall cease [can’t read] & be void to all contents & provision. In testimony whereof the said Ray hath hereunto set his hand and seal the day and year first aforesaid. Unto [can’t read] before signed. Ransom Ray His mark and seal Signed sealed & delivered in the presence of James Adams Alpheus Slay Georgia Meriwether County Personally appeared before me a Justice of the Inferior Court & for said County Alpheus Slay who being duly sworn deposeth & saith that he signed the written Mortgage deed as a witness that he saw James Adams also sign the same as witness & that he saw Ransom Ray sign seal and deliver the same for the purposes therein mentioned.
