First I desire and direct that my body be buried by the side of my first wife. Second I desire that all my debts be paid without delay. Third I desire and direct that my Executors hereinafter named, shall as early as practicable, sell at public sale, all of my property (and without being put to the trouble and expense of getting an order from the Court of Ordinary) both real and personal. Fourth I desire and direct that after my estate is sold that the proceeds of such sale and all other effects I may have be equally divided among my wife Harriet Brook and the following married children to- wit: James H. Brook, Martha T. Montgomery, William P. Brook, Charles S. Brook, Leander F. Brook, Joshua L. Brook, Leonora Todd, Rufus D. Brook, Caroline V. Carden and in the event either one of said children should die before I do, leaving child or children, such child or children shall take in lieu of their deceased parent. Fifth I desire and direct that any and all advances heretofore made, or that may be hereafter made to any of my said children by me shall be accounted for by each of said children so having received any such advance; And any note I now hold or may hold at the time of my death against any of my children shall be accounted as so much advanced without regard to the date of said note. Sixth To the children of my deceased daughters - Susan Woodroof and Sarah C. Allison, I leave nothing but good will, having already done all for them that I am able or willing to do. Seventh I desire and direct that the amount coming to my wife Harriet shall be managed and controlled by my son-in-law, W.R. Todd, and used for the benefit of my said wife, and whatever amount or part not used for her benefit shall at her death be equally divided between my children as mentioned in Item Fourth of this my Will. I hereby constitute and appoint my two sons - James H. Brook and Leander F. Brook Executors of this my last Will and Testament. This the 20th day of October 1886. Hall who on oath says he saw the within named Joshua Brook sign and publish the within paper as his last Will and Testament: that he subscribed the same as witness thereto at the special instance and request of the said Joshua Brook and in his presence, as did also W.J. Barnes and R.D. Adair: that the said Joshua Brook signed the same freely and voluntarily and was at the time of such signing of sound and disposing mind and memory. R.F. Hall Sworn to and subscribed before me this 7th day of January 1895 A.J. Hinton, Ordinary Upon the foregoing affidavit of R.F. Hall one of the subscribing witnesses to the within Will of Joshua Brook, dec’d. It is ordered by the Court that the said Will be admitted to record as satisfactorily proven in Common form; and it is further ordered that Letters Testamentary issue to James H. Brook and Leander F. Brook the Executors named in said Will, upon their taking and subscribing the oath required by law. This 7th day of January 1895. A.J. Hinton, Ordinary
