All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Connie Rayon alaraven@visionsix.com October 11, 2005, 2:06 am Source: Meriwether Probate Office - Book A - Page 202 Written: November 3, 1854 Recorded: March 1855 State of Georgia ) Meriwether County ) Last Will & Testament of Robert Brown Book A - Page 202 I, Robert Brown, of the County of Meriwether and State of Georgia, being in feeble health but of sound mind and memory as hereby proceed to dispose of worldly effects in the manner following to wit: Item 1st: In consideration of the love and affection I bear my wife Melissa Brown, after my final debts are paid I leave her, my said wife, all my land, stock hogs, mule horse, hogs, cows, household and kitchen furniture, provisions on hand, corn, meat and the following slaves, Richmond and Frankey, all the debts due me now or that may hereafter become due together with every interest which I have of every kind whatever for her support and maintenance during her natural life or the time she remains my widow but should she marry then her right ceases and the property remaining at the time of such event shall go as hereafter directed. Item 2nd: I wish and desire my Executrix hereinafter named to pay each of my living children five dollars each, the heirs of my deceased daughter, Caroline five dollars to be equally divided between them, and the heirs of my deceased son, James M., five dollars before she shall be entitled to the provisions of the First Item above. Item 3rd: At the death or marriage of my wife, I then and bequeath in fee simple all my estate loaned my wife or which may then remain to my children: John M., Martha Ann, Elizabeth, Robert P., Nancy Ann, Mary Catherine, the children of my deceased daughter Caroline and the child of my deceased son James, the children of my deceased daughter together ? asking an equal tract only i.e. one-eighth. Item 4th: Should my wife find it necessary to dispose of any part of the property loaned her above for the support of minor children or herself, she is hereby authorized to do so without any application to the Court. Item 5th: I hereby constitute and appoint my beloved wife, Melissa Brown, Executrix of this my Last Will and Testament, and do not wish her to be required to give any security. As such I hereby revoke all wills made by me previous to this time. In witness whereof, I have hereunto set my name and affixed my seal this 3rd day of November 1800 fifty-four {1854}. Jolley, and John M. Griffin, three of the subscribing witnesses to the same Ordered that the same be admitted to Record. Signed: D. C. Gresham ====================================== Meriwether County ) March Term 1855 Georgia ) The Last Will and Testament of Robert Brown, late of said County, died, having been proven at this regular term in Open Court upon the Oaths of Drury Dupress, James L. Jolley, and John M. Griffin. ORDERED that the same find to Record. D. C. Gresham Malisa Brown, the numerated Executrix to the Last Will and Testament of Robert Brown, late of said County died. Appeared this day in Open Court and made known her acceptance of the same by being duly sworn as required by law in such case. THEREFORE ordered, that Letters Testamentary do fine to the said Malisa Brown and that her name be entered when the docket of this Court as such Executrix. DC Gresham ORDERED that William Hodnett, Drury Dupress, Milton Bryd, Rufus Johnson and Methiah A. Thrash find such holding of said Court be and they are hereby appointed the Appraisers of the Estate of Robert Brown, late of said County died. DC Gresham ================================================================== Meriwether County ) Georgia ) Court of Ordinary To the Court of Ordinary of said County: The Petition of Rufus Johnson showeth that Robert Brown died in the County of Meriwether, leaving a will appointing his wife Executrix of the same, who has since deceased leaving the estate of the said Robert Brown, deceased, unadministered, which estate is of the probable value of twenty five hundred dollars and mainly consists of land, negroes, horses, mules and stock of various kinds, and also your Petitioner is a citizen of the Confederate States residing in the said State of Georgia of lawful age. WHEREFORE, your Petitioner prays that Letters of Administration de bonis non cum testamento annexo may fine to him on the estate of said Robert Brown, deceased, which is unadministered, as creditor this ? 5, 1861. Brown and John S. Brown, next of kin of Robert Brown, late of Meriwether County, deceased, and caveats the appointment of Rufus Johnson as Administrator de bonis now cum testamento annexo on the Estate of said Robert Brown, deceased, and says that as next of kin they are entitled to elect who shall have such appointment and they now elect John S. Brown as being the most fit and proper person amount the next of kin for such appointment. WHEREFORE, the Caveators pray that the said John S. Brown be appointed such Administrator as aforesaid. Brown, Administrator with the Will Annexes of Robert Brown, late of said County, deceased, having made application at this term of the Court for leave to sell the perishable property of said Robert Brown, deceased, such application being considered. It is therefore ordered that said John S. Brown have leave to sell the perishable property of said Robert Brown, deceased, upon first giving ten days notice thereof in three public places in said Court. F. WHEREAS, Robert Brown, late of said County, deceased, died intestate, having while he lived and at the time of his death ___ goods, chattels, rights, credits, lands, and tentaments within the County aforesaid by ___ whereof the full disposition and full power of granting the administration of will and singular the goods, chattels, rights, credits, lands, and tentaments of said deceased, and also a final dismission from the same the Ordinary deserving that goods, chattels, rights, credits, lands, and tentaments of said deceased may be well and duly administered and legally disposed ____ hereby grant unto John S. Brown, who son's this day appointed Administrator will power by the tenure of these present to Administer the goods, chattels, rights, credits, lands, and tentaments of said deceased which ___ him in his lifetime, and at the time of his death did belong; and to ask, demand _____ to recover and receive the same and same to ____ the debts no which the deceased stood bound ___ for forth as his assets will extend according to law and then the balance justly ____ over to the legal heirs and distributors of said deceased. And the said John S. Brown, having giving bond and security and taken the Oath and performed all other requisites required by law necessary __ his just qualification as Administrator is by order of said Ordinary and by virtue of __ ordained constituted and appointed Administrator. ================================================ Meriwether Court of Ordinary November Term 1861 The application of John S. Brown, Administrator, with the Will Annexes of Robert Brown, late of said County, deceased, for leave to sell the land and negroes of said deceased, being considered, and it appearing that notice of such application has been duly published.
