Item 1st I resign my body to the grave and my Spirit to the God who gave it. Item 2nd It is my will that after my decease as soon as a sale can take place legally, that my land, farming tools, household and kitchen furniture of every description together with my stock of horses hogs cattle of every kind, Sheep & every other species of stock which I have or may be mine at my decease also my waggon & waggon harness shall be sold on a credit of twelve months which sale I wish attended by my Executors hereinafter named and the proceeds of said sale to be disposed of in the following manner, to wit, after the payment of my just debts my will is that there shall be an equal division among my children to wit Mary Baty who having departed this life my will is that her children to wit, David, Harriet, James and Mary shall be considered an equal heir with my other children they being the legal heirs of my daughter Mary Baty My will further is concerning them — that their distribution share of my estate be managed by my Executors for the benefit of said children and given to them as they may arrive at the age of twenty one years or may marry My will further is that my son Andrew shall have at the division of my Estate one hundred dollars to be taken out of my estate and an equal share of the balance of said estate he not having received heretofore as much from me as some others of my children My will further is that my son James shall have one hundred Dollars and an equal portion of the Residue of my Estate for the same reason that I gave the Hundred Dollars to Andrew My will is that my daughter Jane shall have her bed and furniture and ninety Dollars from the proceeds of the sale of my property and an equal portion of my Estate besides said ninety Dollars My will further is that my daughter Martha shall have her furniture and Ninety Dollars in cash and an Equal portiion of the Residue of my estate My will further is that my son Joseph shall have Twenty five Dollars and an equal portion of the Residue of my estate My will further is that my daughter Elizabeth Bell shall have Ninety Dollars in addition to what she has already received and also an equal portion of my Estate My will further is that my daughters Agnes and Margaret and Lucinda Shall Each have One hundred Dollars and an equal portion of the residue of my Estate For the benefit of my Executors I state that the several amounts heretofore named to be given to my children as aforesaid It is the design to make them equal with my sons George and Newton: My will is that the several amounts should be taken from the whole amount of my sale After paying my debts as aforesaid then my will is for my sons George and Newton and all my children heretofore named and my grandchildren aforesaid being considered as equal heirs Share and share alike of the Residue of my Estate in addition to the several amounts to be given to my children as aforesaid My will is that the children of my daughter Mary Bates shall have seventy five Dollars to be managed by the Executors for their benefit and equally divided among said children It is my will further that my two grandchildren to wit: James A. Bates and Mary A. Bates shall have in addition to that which is allowed them in the preliminary part of this will James fifty Dollars and Mary twenty five and said amount to be used by my Executors for the use of said children either for their Schooling or otherwise as they may think Proper and that said Seventy five Dollars be taken out of my Estate before the division heretofore refered to take place I constitute and appoint my son James Caldwell and my friend William Boyed as my Executors of this my last will and Testament this day & date above written. P.S. In addition to the property heretofore named to be sold My will is that my Negro boy Will shall be sold and every other species of property which may be at (sic) mine at my decease except such a portion of my crop as may be necessary for the support of my family until said sale can be affected after my decease to all of which I hereunto set my hand and seal the day and date above written. Ordered that the same be admitted to record. D.C. Gresham, O.C.C. Per L.M. Adams, L.C. Additional Comments: Grandchildren were referred to as both "Baty" and "Bates." This will was hand copied from the original will book in the courthouse. There were no breaks or paragraphs and little punctuation. Breaks were added by me for ease of reading. The William "Boyed" named above as co-executor was the son of Robert Boyd and Rosannah Stewart. Ironically, the next will in the book, page 116, is that of Robert Boyd and William is, again, the executor.
