Dodds of the County of "Meriwether" and State of Georgia being of sound and disposing mind and memory but infirm in body and being impressed with the uncertainty of Life (the word "and" struck through) feel disposed to make some disposition of the limited Effects now in my possession. In the First Place I desire my family to remain in the possession of all (the word "my" struck through) the Effects that I now possess except such as are hereinafter specified and in Order to secure this end if it becomes necessary so to do, I desire them to avail themselves of the Benefits of all laws, Homestead or any other Character. In the next Place. I desire my Executors hereinafter named to act and do as follows. ~~ At the commencement of Each Year, I desire my family fully supplied for the succeeding year and should there be anything remaining My Executors will Recognise the character of a Debt and from any surplus income I may have pay such Debt accordingly. I desire my Executors immediately after my Death to take charge of my Note book ~~ and Notes and to act in all cases as he may think to the best interest of my family Neither my Executor nor my Executrix will be Required to give any Security of any kind. My Executor will make his Return to my Executrix alone at the Expiration of Each Year and will also See to the agreement and consumation (sic) of all contracts and will render to my Wife (My Extrx) an account current of the Expenses of Her family after retaining pay for his services. I do hereby appoint my Wife as my Executrix and "Moses Almon" as my Executor to carry out these Provisions of this my last Will and Testament. In witness whereof I the said "James M. Dodds" to this my (the words "last Will & Testament" struck through) have set my Hand and Seal. This 4th Day Feby 1870. Jas. M. Dodds [L.S.] Signed and Sealed by the above named James M. Dodds as his will in presence of who at his request in Presence of each other have subscribed our names as witnesses thereunto. William J. Norris Hardy J. Lassiter John R. Brantly Georgia} Meriwether County} Court of Ordinary March Term 1870 The within last Will and Testament of Jas. M. Dodds Dec'd having been offered for Probate at this Regular Term of the Court by the Executrix and satisfactorily Proven upon the Testimony of Hardy J. Lassiter and John R. Brantly Two of the subscribing Witnesses who testified to all the facts necessary to Prove the same, and the signature of the absent witnesses. Said will proven in common form. Ordered That said Will be admitted to Record as the last Will and Testament of Jas. M. Dodds Dec'd and that Letters Test'y do issue to the nominated Executrix upon her qualifying. No other references to this estate in Probate records. James M. Dodds was married to Rebecca Smith. Two of their sons, Eugene Sterling Dodds and Albertus Clay Dodds, both married Sallie Cole, daughter of Robert S. Cole and Nancy Ward, of Meriwether County. The Dodds lived in the Rocky Mount area of Meriwether.
