I therefore make and appoint this my last Will and Testament. First of all I recommend my immortal past to God who gave it and my body to be buried in a decent manner. As to such wordly estate as God has been pleased to permit me to possess and enjoy, I desire that all my just debts be paid by my Executors. Then I give and bequeath unto my beloved wife Nancy Owen during her natural life or widowhood, the houses and plantation whereon I now live and all the lands attached thereto and my negroe man Willis and my negroe woman Chaney and her child or children, and my buggy and harness and carriage nag and a sufficiency of my household and kitchen furniture and stock of all kinds as shall be necessary for her comfort to be adjudged of by my Executors herein after named, together with a plenty of corn meal, wheat and provisions of all kinds for her and her familys support for one year. At the death or marriage of my beloved wife, all the property left to her to return to my Estate and be disposed of as herein after named with the understanding that all the rent proceeds of the farm of my wife over and above a decent support for herself and family to be put out hereafter, by my Executors annually unto her death or marriage, then to be disposed of as the ballance of my Estate. I give and bequeath unto my daughter Rebecca Eubanks a certain tract of land 202 1/2 acres more or less whereon George Eubanks now lives for the use of her and her children during her natural life, at her death to go to the lawful heirs of her body. At the final distribution of my Estate among the ?? and legacies hereinafter named said land to ?? to her in said division the sum of four hundred dollars. If there should be a larger amount than four hundred dollars to each Legatee herein named then my daughter Rebecca to have one equal share after giving that amount to each legatee not otherwise provided for to be disposed of as herein named. I give and bequeath unto my son John G. Owen an equal share of my estate with the rest of the Legatees herein named after settling all the notes and accts. I hold against him. I give and bequeath unto my son Thomas Owen all the notes, executions and accts. I hold against him and one note in the hands of John G. Owen including all demands I have against him which is to be his full share of my Estate. I give and bequeath unto my daughter Jane McDonald five dollars which is to be her distributive share in full of all my Estate. I give and bequeath unto my daughter Elizabeth Parker and my daughter Mary Ann Brown for the use of them and their children an equal share in all my Estate. I give and bequeath unto my gwo grandsons, John H. Owen, James B. Owen, them ? two to have an equal share with the Seceral? Legatees of all my estate to be put out on interest by my Executors until the youngest one comes to the age of twenty one years. If either should die leaving no lawful heirs the other to have all the estate left both in my ?. If both should die leaving no lawful heirs then the portion of property left them in my Will to return to my Estate and be disposed of as the ballance of my Estate. My desire is that after my death as early as practicable my Executors shall proceed to sell such portion of my Estate as not otherwise disposed of in my Will with any cash or notes to make distribution amoung the Seceral ?? Legatees in manner hreinafter pointed out after paying off my just debts unless the amount should be so small that it should be best not to do so and in that case to be put out as interest until the final distribution. If any of the Legatees should be dissatisfied with this my Last Will and should go to Law to break or change the meaning and intent of the same, my desire is that they get five dollars only as their distributive share in full of all my Estate. I appoint Nancy Owen, William Brown and William C. Roper ?, my Executors to act on and carry out this my Last Will and Testament. In tiwntess of my intention ?, I have hereunto set my hand and affixed my seal this the 12th day of August in the year of our Lord One Thousand Eight Hundred and Fifty One. Geo.
