Second - - As it is my will and desire that my property all be equally divided between my children now in life and the children of my deceased daughter Mary Jane Cochran (the latter to receive the same share of their mother would have been entitled to in life) after deducting what I have already given to each of them heretofore, which is as follows: My daughter Mary Jane Cochran has received in negroes and land, property of the value of fourteen thousand dollars. My daughter Willie E. Martin has received negroes, property of the value of twelve thousand dollars. My daughter Caroline E. Martin has received in negroes, and money, property of the value of five thousand nine hundred dollars. My son Samuel M. Wellborn has received negroes, property and money of the value of twelve thousand nine hundred and fifty dollars. The negroes which I have given to my son are now on my place taken with my other negroes to wit, Nace, Ellen, Richard, John, Lem, Charlotte, Frances, Charity, Mike, Louisa, Louesey, Jessy, Little Henry, Attila, Spring, Emeline and her child Seaborn, and Hubbard. Green is also with my slaves but was purchased by my son with money advanced by me to him and is his property. I have given my daughter Catherine three Negroes to wit: Lucy and her child and Jack which are now at my house and employed as house servants of the value of sixteen hundred dollars. Now it is my Will and intention that my son and three living daughters shall receive in Negroe property the same amount which my daughter Mary Jane Cochran received to wit: fourteen thousand dollars and what each one lacks of receiving that amount heretofore, they are to receive in men and women the men to be valued at one thousand dollars each and the women at eight hundred dollars each, that is to say, like young men and women and other Negroes in the same proportion. Third - - It is my Will and desire that when my living children shall have received in Negroe property the same amount as received by my deceased daughter Mary Jane Cochran to wit: fourteen thousand dollars to be valued as stated in the proceeding clause of this instrument, so as to make their respective shares equal to what she has, that then the ballance of my estate both real and personal shall be equally divided between my children and the children of my deceased daughter Mary Jane Cochran, the latter to receive the share to which their mother would have been entitled to in life, to wit, the one fifth part thereof, share and share alike. And in the event that my daughter Catherine should depart this life without any child or children living at the time of her death, then it is my will and desire that the share or portion of my property bequeathed to her by this my last Will and Testament shall be equally divided between my surviving children and the children of my deceased daughter Mary Jane Cochran, the latter to receive the same share as their mother would have done if in life. Fourth - - It is my further will and desire and interest that each and eery part and portion of my estate bequeathed and decreed unto my daughters Willie E. Martin, Caroline Martin and to my daughter Catherine by this my last Will and Testament or any clause thereof shall be and is hereby bequeathed and devised unto them for their sole and separate use free from the debts or contracts of their present husbands or any future husband that either of them may at any time hereafter have or marry, it being the true intent and meaning of this my Last Will to secure the said property and every part thereof to the sole and separate use of my said daughters and their children, free from the debts, contracts or liabilities of their present or any fuyure husbands wich either of them may at any time hereafter have or marry, and their separate receipts therefore shall be a sufficient discharge to my Executor or legal representative of my Estate. In testimony whereof I have hereunto set my hand and affix my seal this 6th day of August 1857. Alfred Wellborn (seal) Signed, sealed and published in the presence of: Thos. F. McGehee, Sarah R. McGehee, Louisa J. McGehee State of Georgia, Meriwether County Before me, Parris C. Gresham, Ordinary and Ex-Officio Clerk of the Court of Ordinary in and for said County and State, Samuel M. Wellborn personally came and produced before me the Last Will and Testament of Alfred Wellborn, late of said County, deceased, and the witnesses to said Will, to wit: Thomas F. McGehee, Sarah R. McGehee and Louisa J. McGehee, which witnesses being duly sworn depose and say that they saw Alfred Wellborn the Testator sign, seal and declare and publish this instrument now presented as his Last Will and Testament freely, voluntarily and of his own accord and without any compulsion or influence whatever, that the time of the execution of the said Will, said Testator was of sound disposing mind and memory, that deponents signed said Will as witnesses in the presence of the Testator and in the presence of each other.
