Will of Henry Harris 28 Nov 1858 Meriwether County, GA Meriwether Co., GA, Will Book A, pp. 272-275 Georgia Meriwether County In the name of God amen. I Henry Harris of the State and County aforesaid impressed with the great uncertainty of life and the importance of arranging both our temporal and spiritual interests with reference to that final summons which sooner or later awaits all the living being of sound mind and disposing memory do hereby make publish and declare the following disposition of my Estate. First I desire all my just liabilities to be discharged. Secondly I hereby ratify and confirm the dis-position of such property as I have heretofore made to my dear children and their lineal descendants. Thirdly I hereby give and bequeath unto my beloved wife Mary Harris the following property together with all the natural increase proceeds and profits, arising there from to wit. Ke(s?)iah David and his wife Lucy and their children Jerre Augustus, Laura, Rich, Sophronia, Letty and an infant. Also ($2000) two thousand dollars in cash, my household and kitchen furniture, Carriage and horses, and one sixth part of such crops as my be on hand or growing at the time of my decease. Fourthly I also will and desire to loan my beloved wife, during her natural life the following property to wit. Shadrac, Harry Washington Alfred Mariann and her children Warner [?] and his wife Mary and Rainy, also one sixth part of my stock farm implements together with the house and lot whereon I now reside with the track of land adjoining containing two hundred and eighty acres more or less. Fifthly I also will and desire that the property loaned my dear wife during her life as des-ignated in the fourth item of this instrument shall at her death revert to my estate and be equally divided between my five dear children to wit. Benjamin T, Samuel W, Henry R, and William T. Harris and Mary Ann Sasnett share and share alike. Sixthly I also will and bequeath to each of my herein named grandchildren (the children of my deceased daughter Elizabeth Hall late of the State of Louisiana to wit. Dixon, William, Bolling, Francis [Frances ?] and Emmet each the sum of ($1200) twelve hundred dollars. Seventhly I also will and bequeath to my son Benjamin T. Harris the sum of four thousand dollars to be held by him as a trust fund for the benefit and use of my two little grandson to wit. Benjamin & Wilmot Hall sons of my deceased daughter Elizabeth Hall, and I wish to provide that in the event of the death of either of my grandson before reaching their majority the said trustee shall pay over the entire sum to the surviving brother (Benjamin or Wilmot as the case may be) Eighthly I give and bequeath to my daughters Nancy Slaton of the State of Alabama the sum of $2000 two thousand dollars and to each of the following children of my said daughter Nancy Slaton to wit. Mary, Henry, William, Rebecca, Martha and Caroline one thousand dollars. Ninthly I further give and bequeath unto my said daughter Nancy Slaton the sum of one thousand dollars to be held by her in trust for the use and benefit of her three grand children (the children of her deceased daughter Sarah Frances Smith.) Tenth I request and desire my Executors her in after appointed to pay off the specific legacies herein made so soon as the interest of the estate will authorize and the rights of the respective legatees shall be a full satisfaction of all claims they may have had on my estate, and a complete discharge of my Executors from all legal liability on account thereof. Eleventh The entire remainder of my Estate both real and personal consisting of lands, Negroes, stock, plantation implements, crops, money, notes and accounts, I hereby give and bequeath equally to my five children to wit Benjamin T. Samuel W. Henry R. and William T. Harris and Mary Ann Sasnett share and share alike. 12th I hereby nominate and appoint my dear sons Benjamin T. and Henry R. Harris my legal and exclusive Executors conferring upon them full discretion as to the manner in which my Estate shall be closed (up ?) with the request that particular reference be had for the health and comfort of my aged servants and in the dis-tribution of my Negroes there be no separation of husband from wife nor of young children from parents. Lastly Revoking all other wills and testaments I hereby declare this to be my last and only will and testament.
