Howard Georgia } Item 1st: In view of the uncertainity of life and the dangers to which I am exposed in the war of the Confederate States, I deem it right and proper that I should make such a disposition of my worldly effects as will must promote the welfare of wife and children. I, therefore, make and publish this as my Last Will and Testament hereby revoking all others heretofore made by me. Item 2nd: It is my Will, and I so direct that all of my estate, both real and personal, be kept together for the support and maintenance of my beloved wife, Elizabeth H. and my children, during the life or widowhood of said wife, Elizabeth H., and in the event of the death of my said wife, then all of my property of every kind whatever to be equally divided between my children: but, should a division of my estate take place upon the marriage of my said wife, thus all of my property of every kind description whatever together with the profits or income of the same to be equally divided between my said wife and children. Item 3rd: It is my Will and I so direct that my Executrix herein after appointed, have power to control and manage my Estate in as full and ample a manner as I could do, though I were living, for the purposes as expressed in Item Second of this Will, and she is hereby empowered to buy and sell for with an account of my Estate Item 4th: I hereby appoint and constitute my beloved wife, Elizabeth H. Executrix to this my Last Will and Testament, with full power to execute the same. In witness whereof, I have hereunto set my hand and seal, this March 25th 1863. Wiley J. Howard, having been proved for Probate at this regular term of the Court in commons form and satisfactorily proven upon the Oaths of E. Winslow and C. W. Crosson, subscribing witnesses who testified to all the facts necessary to prove the same ORDERED……. That the same be admitted to Record as the Last Will and Testament of said deceased as proven in common form, and that the nominated Executrix, Mrs. Elizabeth H. Howard, be and she is hereby allowed to qualify, and upon her so doing, that Letters Testamentary issue to her. This November 4, 1878. A. J.
