In the name of God Amen. 

I, Josiah T. McLaughlin of said State and County knowing the
uncertainty of life and being desirous of making the best
possible disposition of my property for the protection of my
wife and minor children do therefore make this my last Will
and Testament hereby revoking all others heretofore made by
me.

Item 1 I desire and direct that my body be buried in a
decent and Christian like manner, suitable to my
circumstances in life.

Item 2 I desire and direct that all my just debts be paid
without unnecessary delay as I am unwilling my Creditors
should be unnecessarily delayed in their rights.

Item 3 I give and bequeath to my beloved wife Mary Ann J.
McLaughlin for and during the term of her natural life or
widowhood all of my Estate both real and personal of every
kind whatsoever and wherever it may be found, to use and
control, sell and dispose of the same for the benefit of
herself or my creditors in as full, free and ample a manner
as if she had an absolute property therein without any
limitations or restriction whatever.  I further desire that
whenever my wife shall wish to sell or dispose of any of my
property for the benefit of herself or my creditors as
aforesaid she shall do so without obtaining the permission
or order of any Court having Jurisdiction of such matters
and that she shall moreover, be empowered to sell and
dispose of said property absolutely alienating not simply
the life Estate but also the fee and thus making good
complete and perfect titles to the purchasers thereof.

Item 4 If my wife should at any time marry I then desire
that all my Estate property then remaining shall be
appraised and divided into equal share portions by three or
more suitable persons to be appointed by the Ordinary of
said County, and distribute between herself and my children
share and share alike giving to my wife simply the choice
shares and permitting the remaining shares after her
election to be distributed among my children by lot.  Should
my wife however die without marrying, I then desire that
portion of my property remaining at her death to be equally
distributed among my children share and share alike, the
appraisement and division into shares being made according
to the method before specified in the event of her marriage
and the distribution of said shares among my children to be
made by lot.

Item 5 I leave it entirely to the discretion and judgement
of my wife to advance to any our children such portions of
property, at such times as she may feel willing and able to
advance without inconvenience to herself.

Item 6 I desire that my Executrix hereinafter named shall
not be under the necessity nor burdened with the trouble and
expense of making any inventory of my Estate or any returns
whatever to the Court of Ordinary.

Item 7 I hereby constitute and appoint my beloved wife, Mary
Ann J. McLauglin the sole Executrix of this my last Will and
Testament and also the Guardian of my minor children, this
the third day of February 1863.

McLaughlin as his last Will and Testament in the presence of
us the subscribing witnesses who subscribed our names hereto
in the presence of said Testator at his special instance and
request and of each other this February 3, 1863.

Court of Ordinary January Term 1871

The last Will and Testament of J.T. McLaughlin having been
offered for Probate in common form at this Regular Term and
satisfactorily proven upon the testimony of Chas. F.
Humphries one of the subscribing witnesses.

That the same be admitted and Executrix has leave to qualify
and upon so doing that Letters Test. issued to her.
