I, Elijah B. Bush, Sr., being of sound and disposing mind and memory; knowing the uncertainty of life and the certainty of death and feeling that I should make disposal of The earthly property and the effects which the Lord in his goodness and mercy has seen Fit to bless me with in this life, do make and constitute this, my last will and testament, Hereby revoking the one written and signed on April 10th, 1903, as well as others heretofore made by me. 1st: I will that my body be buried in a Christian-like manner, but in a style and manner as my circumstances in life will warrant. And that while my body is consigned to its Mother dust, my spirit may take its flight to the blessed Jesus Christ who gave himself for it, and in whom only I have hope of immortality beyond the grave. 2nd: I will that after my debts be paid by my executors hereinafter mentioned. 3rd: I will that after my debts are paid, that all of my property, both real and personal, belong to my wife, Susan A. Bush, the same to be used by her in the support of herself and minor children, Elijah B. Bush, Jr., and Thomas William Bush and in the education and support of the above minor children (in case she should live longer than I do). And in the event of her death before said minor sons shall arrive at the age of twenty one years of age, I will that a sufficient amount be set aside out of my estate for their support and education until they shall become of age, I also will that after this is done, the rest of my property shall be divided share and share alike, after the oldest children now married shall have accounted for all advances made to them since their marriage. 4th: I will that the event of my death, and the death of my wife above mentioned, that the two daughters of my deceased daughter, Virginia D. McNair; viz: Annie Sue and Nannie Fay McNair shall have their mother’s distributive share of my estate, with the distinct understanding that in case of the death of either one of said children, the whole of mother’s share of my property shall (in case they die without issue) go to the surviving sister, and in case they both die without issue, all of said property shall revert to my estate and be divided among my children or their heirs of their body, and it is expressly provided in this will that A.G. McNair, the father of the above named children shall not under any circumstances have control over any part of said property, but that my executors shall appoint some other good and discreet person trustee for said minor children; who is to give bond and take charge of the said property, and to keep the same in trust for them until they shall have arrived at the age of maturity, or until they shall have married a man of lawful age, than and in that, said property shall be turned over to them. 5th: I will that my daughter, Julia Rich, shall have and receier her share of my estate as above mentioned in item 3 of this will; and it is expressly provided that said property shall not be used by anyone else except herself; that she shall have exclusive control of same, and that said property shall not be used by her husband or in any manner incumbered by him; nor shall it be subject to any judgment, lien or decree of the court against herself and him jointly, but that said property shall be kept exclusively for the benefit of her and her children, and not to be sold or disposed of on any other account whatever; and in case of the death of my said daughter, Julia Rich, her share of my property shall go to the heirs of her body alone, and I direct that bond be required for by their guardian (by my hereinafter executors for the faithful carrying out of the provisions of this item). 6th: I hereby appoint and constitute my beloved wife, Susan A. Bush, executor of this will during her lifetime, and in the event of her death, I appoint my beloved sons, O.B. and John R. Bush my executors, with full authority to carry out this will according to the provisions herein contained without bond; said executors to be required to settle up my estate according to the requirements of the laws of this State. I direct further that my executors shall dispose of my estate as the law now directs for the settlement of estates is: by making returns to the Ordinary etc. In testimony whereof I have hereto set my hand and affixed my signature This the 24th day of August, 1904.
