I, West Sheffield, of the County of Miller and the State of Georgia, being of sound and disposing, mind and memory and being desirous to settle my worldly affairs while I have strength to do so; do evoke this my last will and Testament, hereby revoking all wills by me at any time heretofore made, and first I commend my soul to the God who gave it, and my body I desire to be buried in a decent and Christian-like manner. And my worldly estate I dispose of as follows: Item 1: I desire that my just debts be paid by my Executrix hereinafter named. Item 2: In the event I should die before a tomb is erected over my deceased father’s grave, similar to the one over my mother’s grave, I direct that my executor has one erected at the expense of my estate, if the other heirs refuse to give their part towards the erection of the same. Item 3: I give and bequeath to my son Aurthur John Westly Sheffield lot of land no. 40 in the 13th District of Miller County, containing 250 acres more or less. East half of lot no. 41 in the 13th District of Miller Co., containing 125 acres more or less. Item 4: I give and bequeath to my dau. Pametia Rebecca Sheffield, one half lot no. 381 in 6th district originating Early ??? Miller County, containing 125 acres more or less, also no. 1 in ??? Miller County containing 250 acres more or less. Item 5: My gin house and shop I desire to be kept for both my children, jointly and never to be sold unless by agreement of the heirs to sell to each other. This includes the ground on which they stand. Item 6: I will that none of my property be divided or sold (except as hereafter provided) during the life or widow-hood of my beloved wife, Mary Sheffield, But she is to keep the same together and manage it for the interest and support of my son and dau. named above, and also for their education. Should my wife die or marry during the minority of my children or either of them. I desire that the guardian of such children or child, manage my estate according to the directions given my widow, as above in this item. Item 7: Should my wife die or marry during the minority of my children, it is my will that the property bequeathed to them in this will be kept together for their benefit until they arrive at the age of maturity, and that it be manage by such Guardian as may be lawfully appointed for them or either of them. Item 8: Should my children herein ??? named arrive at the age of maturity during the widow-hood of my wife Mary, she is to hold the estate together still for the interest of herself and them. Allowing them land to cultivate without rent or charge with stock sufficient for that purpose in her discretion. Item 9: The remainder of my land and ???? property not heretofore bequeathed, I desire shall be sold at the death or marriage of my widow, at public or private sale in the discretion of the guardian of my children. Unless I should between this time and my death purchase lands adjoining the plantation whereon I have now. In this case the land so purchased I desire should be equally divided between the two children, at the death or marriage of my widow or in case she dies or marries during the minority of my children, then to be divided when they arrive at majority and at the same time the lands herein before bequeathed to them and set apart to them. Item 10: I desire that my personal property of ??? description, be divided equally between my son and dau, herein before named. But in the meantime should my widow or the guardian of my children find it necessary to sell any of my personal property for the purpose of maintaining my widow and children, or of educating my children, it is my desire that it be done in the sound discretion of the widow or guardian. Item 11: I will that good and substantial buildings be erected on the land bequeathed to my son, Arthur John Westly, at the expense of my whole estate, so that the ??? prov???? Will compare favorably with the ??? given my dau. Item 12: The property given to my Dau. is to be forever free from any debts or liabilities of any husband she may have at or before my death. Item 13: Should either of my children die without lawful issue then the surviving child should inherit such property as is given by me to such deceased child. Item 14: I hereby constitute and appoint my beloved wife, Mary Sheffield, Executrix to this my last will and testament to carefully set up and see its provisions justly carried into effect.
