Simmons, John Smallen & Davis Smith Justices of the Inferior Court aforesaid of the County of Monroe of the one part and John Funderburk of the County of Monroe of the other part. Wetnesseth that the said John K. Simmons, John Smallen & Davis Smith for & in consideration of the sum of Fifty three dollars in hand paid at & before the sealing delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold alieved conveyed and confirmed and by these presents and by the power in them vested as Justices of the Inferior Court of the said County of Monroe aforesaid due by an act of the Legislature of the State of Georgia pased authorizing the Justices as aforesaid to sell lots in the Town of Forsyth in said county to grant sell alien convey and confirm to the said John Funderburk his heirs and assigns all that lot or parcel of land lying in the Town of Forsyth containing one acre and number eighty eight. To have and to hold the said lot or parcel of land with all and singular the rights members and appurtenances thereof whatsoever to the said primises belonging or in any wise appertaining with the remainder of _________________________________________ and profits thereof to the only proper use benefit and behoof of the said John Funderburk his heirs excutors administrator and assigns in fee simple and the said Justices aforesaid the said bargained lot or land unto the said John Funderburk his heirs executors administrators and assigns against the said Justices and all and every person or persons shall and will warrant and forever defend by virtue of these presents have hereunto set our hands and affixed seals the day and year first above written.
