J. Mason of the same place of the other part, witnesseth. Now whereas the said Mark Ray and Nancy his wife have mutually agreed, in consequence of vaious unhappy differences which have of late occured between them to live separately and apart from each other during the remainder of their lives. And whereas the said Mark Ray had agreed and does hereby agree to allow his said wife Nancy Ray the full use and enjoyment of all the property which she the said Nancy Ray possessed at the time of her intermarriage with him the said Mark Ray, or which may have come or fallen to the said Nancy in her own right, by descent or otherwise since said intermarriage, and with the right also on the part of the said Nancy to dispose of all or any part of said property by gift or sale in fee simple or otherwise, at her own will and pleasure, without any let or hindrance, now or here after on the part of the said Mark Ray his heirs or assigns or any or either of them. And this Indenture further witnesseth that in assurance of said agreement herein above mentioned between the said Mary Ray and Nancy his wife, he the said Mark Ray for himself his heirs executors and administrators doth hereby covenant promise and agree with the said Jefferson A. J. Mason his executor and administrators in manner following that is to say that it shall be lawful for the said Nancy and that he the said Mark Ray shall and will from thence forth permit and suffer her the said Nancy at all times here after during the joint lives of them the said Mark Ray and Nancy Ray to live separately and apart from him the said Mark Ray and to go reside and be at such place and places and with such family and families, relations, friends and others as the said Nancy notwithstanding her coverture, shall from time think it wholly freed and discharged from all power, authority, governance and restraint of him the said Mark Ray, in like manner in all respects, as if she the said Nancy were a single woman or ferne sole, and the said Mark Ray shall nor nor will at any time, or times hereafter sue, molest, or distrub or cause to be sued molested or distrubed by legal prossess, threats, or otherewise howsoever, the said Nancy his wife for so living apart from as aforesaid, nor any person or persons whomsoever for receiving, boarding, protecting or entertaining her during such separation. And the said Mark Ray does hereby for himself his heirs, executors and administrators further covenant promise and agree with and to the said Jefferson A. J. Mason his executors and administrators, that all things here in covenanted to be done and performed by him the said Mark Ray his heirs executors and administrators shall be well and truly performed and done by him the said Mark Ray and each and every one of them. And further that the said Mark Ray his executors and administrators or some or one of them shall and will well and truly pay all the judgements heretofore obtained and now existing against the said Nancy and which were obtained before said conventure, and shall so pay off and satisfy the same that they nor no part thereof shall be outstanding and of force against the said Nancy or her Trustee; or her separate estate and in consideration of the paying off and satisfying said existing judgments, the said Jefferson A. J. Mason, shall and will at all times hereafter during the joint lives of the said Mark and Nancy Ray keep harmless the said Mark Ray and his executors and administators and his estate from and against all such debts and contracts as may hereafter be formed and contracted by the said Nancy. And the said Jefferson A. J. Mason doth further convenant with the said Mark Ray his heirs executors and administrators that the estate of the said Mark Ray shall now and at all times hereafter stand free and discharged from all manner of claim or demand whatsoever on the part or behalf of her the said Nancy Ray or her heirs for dower maintainance alimony or any distributive share or portion in or to the estate of him the said Mark Ray. She the said Nancy Ray hereby freely asserting to the approving of the convenant so on her part and behalf made by the said Jefferson A. J. Mason and the said paaarties of the first and second part, for the true performance of all things herein stipulated to be done performed or forborn bind themselves each party to the other in the sum and penalty of two thousand dollars to be recovered and lived of their and each of their goods and chattels lands and tenements. In testimony whereof each of the parties respectively have hereto subscribed their hands and affixed their seals the day and year first above written. Hartsfield a Justice of the Monroe County peace in and for said Nancy Ray separately and apart from her husband declares that she freely asserts to all things convenanted to be done and forborn on her behalf by the within Jefferson A. J. Mason, and that it is the wish and desire of her the said Nancy Ray that the within deed should be executed and stand good.
