I John Gibson of the State of Georgia and County of Warren am weak of boddy but of a Sound and perfect memory for which I bless God for being desirous to dispose of what God has blessed me with as equally as I can in manner and form as follows. Towit First. My will and desire is that all my just debts be paid by me Executors hereafter named. 2d. I give unto my beloved wife Clarry Gibson Four thousand dollars in money or the value thereof or any part thereof she at her option may take any part of my property at the praise value she may think proper. 3d. In order that equal justice may be done to all my children hereafter named and to prevent any dispute that may hereafter arise to the division that may take place as some of my children has had more than others I consider it my duty I owe to all to state here what each Legatee has received prior to this date, viz, John Gibson Decd. had in his life time Two Thousand nine hundred & Sixty dollars. Churchill Gibson has had Three Thousand Eight hundred dollars Henry Gibson has had Five Thousand Eight hundred seventy dollars Nancy Gorman has had four thousand nine hundred & thirteen dollars Sarah Tucker has had Two thousand five hundred & ninety four dollars Now my will is that my son Churchill Gibson and the estate of John, John Gibson decd and my daughter Nancy Gorman & the children hereafter named of Sarah Tucker that each and every of their parts be made Equal to what my son Henry Gibson has received that is to say the last four parts, or Legatees be equal to be made to the amount of Henry Gibson had received, being the one received the highest sum. Now my will and desire for this is that all my Estate both real & personal be sold to the highest bidder and the money or amount arising from the same and also the notes of hand or other instruments in writing and open acct after paying all just debts and the wifes Legacy and Each Legatee to be made equal to the amount Henry Gibson has received the balance of said estate or the value in Cash be equally divided Amongst the five Legatees, that is to say my Sons Churchill Gibson Henry Gibson the heirs of John Gibson deceased Nancy Gorman and the children of Sarah Tucker, deceased, viz Edmund Tucker, Mathew Tucker Mark Tucker, Lucretia Tucker Julia Tucker & Marian Tucker being entitled to their mothers part, to them & their heirs and assigns forever. 4th I do hereby appoint my Son Churchill Gibson, Henry Gibson and Martin Kolb my Executors to this my last will & Testament & I do hereby revoke all other Wills & Testaments deed of Gifts or any Instruments in writing by me made, In Testimony whereof I have hereunto Set my hand and affixed my Seal, this Eighth day of August One thousand eight hundred & Twenty Six. Beavers D Clk Co. } John Wright Georgia } Court of Ordinary April Term 1829 Campbell County } Personally appeared in open Court Micajah Perry & after being sworn deposeth & saith that he saw John Gibson sign seal publish & declare the within writing to be & Contain his last will & Testament that at the time thereof he the said John Gibson was of sound disposing mind & memory & that he did it freely without compulsion to the best of his Knowledge & that he saw Robert Walton the other Subscribing witness assign it also.
