Monroe County, GA will of Margaret Cummings Ponder Submitted by: Meredith Clapper Georgia, Monroe County} In the name of God, Amen. I Margaret Ponder of the State and County aforesaid being in sound and proper memory thanks be to God for the same calling to mind the mortality of my body, and knowing that it is appointed for all men to die, do make this my last will and testament. That is to say: First of all I recommend my soul to God that gave it and my body to the Earth to be buried in a christian like and decent manner at the discretion of my Executors nothing doubting but at the general resurrection I shall receive it again by the power of the Almighty God. And as touching such worldly estate as it has pleased God to bless me with in this life I give and bequeath in the following manner: viz 1st I will that all my just debts be paid out of my estate. 2nd I will and bequeath that my son James Ponder have fifty dollars over and above his equal share out of my estate. 3rd I will that my Negro woman Annaca be sold by my Executors either publick or private sale as they may think proper to sell her. 3rd (sic) I will that all my Estate be sold and placed in one stock and the balance not heretofore disposed of be equally divided as follows: to my son James Ponder an equal share, to my son Amos Ponder an equal share, to my son John L. Ponder an equal share, to my Daughter Jemima B. Mitchell an equal share, to my son Daniel Ponder an equal share. to my Daughter Malinda Gilleland an equal share. to my grandchildren the children of my son Silas Ponder, namely Lurany E. Ponder, Pegga Ann Ponder, William A. Ponder & Martha Ponder orphans of my said son Silas Ponder dec'd, what would have been his equal share had he lived with the exception of a deduction of thirty dollars which I have paid to a lawyer. 4th I do make and ordain and appoint my sons Amos Ponder and Daniel Ponder my Executors to carry this my last will and testament into effect. Ponder Georgia Monroe County} Personally came before me John H Banks and Thomas W O 'Neal two of the Justices of the Inferior Court in and for said County Dulane F Ponder who being duly sworn deposeth and saith he saw Margaret Ponder sign, seal, publish, & declare this writing as & for her last will & testament that he in the presence of said testatrix & at her request & in presence of Bird Bryant & John L Ponder attested said will as a witness, & that said Bird Bryant & John L Ponder attested said will as a witness & that said Bird Bryant & John L Ponder in presence of said testatrix & at her request & in presence of this deponant & of each other attested said will as witnesses & that said Margaret Ponder at the time of the execution of said will was of sound and disposing mind and memory & that she executed the same freely, voluntarily, & without compulsion.
