Written: June 27, 1845 Recorded: November 4, 1850 This is the will of Jesse Powell from Will Book B (1847-1865), pages 59-61. Georgia Monroe County In the name of God Amen. I Jesse Powell of said State and County, being of advanced age, and knowing that I must shortly depart from this world, deem it proper, both as respects myself and my family, that I should make a disposition of the property with which a kind Providence has blessed me. I therefore make this my last Will and Testament, hereby revoking and annulling all other heretofore made by me. Item first. I desire that my body be buried in a decent and Christianlike manner, suitable to my circumstances and condition. Item second. I will and desire that my wife Sarah Powell have one of my negroes to wait on her during her natural life, allowing her to make her own selection I furthermore desire that my Executors shall reserve an amount sufficient for her support during her natural life. Item third. I will and desire unto my son John Powell and his heirs Lot of land No. eighty six, lying and being situated in the fifth District of Monroe County and State aforesaid, it being the lot of land upon which I now live. Item fourth. It is my will and desire that the remainder of my land property together with my household stuff and stock of all kinds, and corn, fodder to be sold (save a bed & furniture for the use of my wife Sarah Powell) and the proceeds, after reserving an amount sufficient for the support of my wife Sarah Powell her natural life, be equally divided between my four children viz. my son John Powell and my daughter Elizabeth Howell wife of Burwell Howell and my daughter Laney Williams wife of Duke Williams and my daughter Mary Middlebrooks relic of Thomas Middlebrooks decd. Item fifth. It is my will and desire that my negro property (after reserving one for the use of my wife Sarah Powell her natural life) be equally divided between my four children and their heirs above named. Item sixth. It is my will and desire that the negro property willed to my daughter Mary Middlebrooks be placed in the trust of my executors hereafter to be named for her benefit and use during her natural life and her heirs at her death, free from the disposition of any future husband, and I hereby appoint my son John Powell and my son in law Duke Williams trustees for the property herein bequeathed to my daughter Mary Middlebrooks and her children. Item seventh. I will and desire the property left for the use of my wife Sarah Powell at her death be equally divided between my four children above named. Item eighth. I constitute and appoint my son John Powell and Duke Williams Executors to this my last Will and Testament. Georgia Monroe County I do solemnly swear that this writing contains the true last will of the within named Jesse Powell deceased, so far as I know or believe - that I will well & truly execute the same by paying first the debts and then the legacies contained in said will as far as his goods & chattels will thereunto extend & the law charge me, and that I will make a true & perfect Inventory of all such goods & chattels - so help me God.
