First, I recommend my soul to God who gave it and my body to the earth to be decently buried at the discretion of my executors herein after named and my worldly estate payment and satisfaction of all my just debts. I give and bequeath as follows (that is to say), I give and bequeath to my son, Floyd Whatley, one negro man named Jacob. I give and bequeath to my son, Walton Whatley, the following negroes vis Hannah a woman, Sam a man, Jim a man, Mary a girl and John a child. I give and bequeath to my son Vachel D. Whatley two negroes vis Clary a girl and Ephraim a boy. I give and bequeath to my daughter Matilda Johnson five dollars. I give and bequeath to my daughter Sarah Collier one negro named Fanny. I give and bequeath to my son Robert A. Whatley two negroes vis Willie a man, and Peter a man. I give and bequeath to my two sons Walton Whatley and Robert A. Whatley my lands where on I dwell, also all my stock, plantation tools, household and kitchen furniture to be equally divided between them both. I give and bequeath to my grandchildren Robert W. Johnson, Jesse Johnson, Vachal D. Johnson, Mary Johnson, Elizabeth Frances Johnson, Matilda Jane and Sarah Jane Johnson the lawful heirs of my daughter Matilda Johnson, also her unborn child or children one negro girl named Sylvia to be equally divided amongst them all when the youngest one becomes of age. And I do hereby constitute and appoint my son Vachal D. Whatley trustee for said children who is hereby empowered and legally authorized to manage and control said trust property and dispose of the services of the same as he many think most to the benefit and interest of said minor children. I give and bequeath to my grandson Cicero Columbus Whatley one forty acre lot of land bearing my gold mine lot in the county of Cherokee, second section, fifteenth district number 364. And lastly I do hereby set apart, constitute, appoint and ordain my two sons Walton Whatley and Robert Whatley executors to this my last will and testament to which I have hereunto set my hand and seal this the 14th of December 1840 in the year of our Lord, one thousand eight hundred and forty. Signed, sealed, published and declared by the testator to be and contain his last will and testament who in his presents and of each others at his request subscribed as witnesses thereunto. Duke the witnesses to this foregoing will who being duly sworn depose and say they saw Robert Whatley sign, seal, publish and declare the forgoing for his last will and testament. That they in the presence of the testator and at his request and in presence of each other attested said will as witnesses and that said testator at the time of this execution of said will was of sound and disposing mind and memory and that he executed the said freely, voluntarily and without compulsion. Green Duke John Burt John E. Duke Sworn and subscribed in open court May 1st, 1848 E. G Cabanip, Clerk The last will and testament of Robert Whatley deceased having been proven in open court upon the oaths of Green Duke, John Burt, and John E. Duke the subscribing witnesses thereto. It is found by the court that the said will be admitted to record and that letters testamentary be granted to Walton Whatley one of the executors in said will appointed. I, Walton Whatley, do solemnly swear that this writing contains the true last will of the within named Robert Whatley deceased. So far as I know or believe that I with will and truly execute the sa??? by paying first all debts and then the legacies contained in said will a far as his goods and chattels will thereunto extend j??? law charge in?? and that I will s??? a true and perfect inventory of all such goods and chattels so help me God.
