First. -- I recommend my soul to God who gave it, my body to be buried in a decent manner. Secondly. -- My will and desire is that all my just debts be paid oit of property not willed to my two daughter, who will be named hereafter in this will. Thirdly. -- I will to my wife Lucy J. Whatley, five dollars only. My reason for this so doing is because she has entirely forsaken me, and has removed a distance from me and has taken away from my residence all the property she brought to my house at and after our marriage. Fourthly. -- I give and bequeath to my two daughters Mary S. Whatley and Sarah A. Whatley, the land whereon I now live, being half a lot of land, with all the stock, household goods, stock of all kinds that I possess. Working tools, oxen and cart, and the crop that may be raised on the premise the present year. Fifthly. I further will and ordain that the land that I own called the Crawford place be sold by my executor without any order of court according to his own good pleasure, and he fully clothed with authority to make title to the same under any manner of sale he may make of it, the sale of the land to be applied to the payment of my debts, or as much of the proceeds as may be necessary for that purpose. Further, if the sale of the Crawford Place should not be sufficient to pay all my debts, my executor will select property that I have willed to my two daughters that he may think can be best spared to pay the balance. Further, my old negro man Jacob, if he is not freed, should belong to my two daughters, and if free, I desire he would remain on the premises and receive a part of the crops he may raise for compensation. My will and desire is that my brother Walton Whatley be my executor and in case of his death or refusal to act, Daniel Godard, Sr. to act as my executor and this is their authority to act and is as full authority as I am able to confer on them -- all these acts to be valid without any order of court. In witness whereof I have hereunto set my hand and fixed my seal this 5th day of June in the year of our Lord eighteen hundred and sixty-five. Floyd Whatley (seal) Test: Susan T. Godard Elizabeth D. Whatley, two of the subscribing witnesses who, having made oath say that they saw Floyd Whatley sign, seal and declare the foregoing paper as and for his last will and testament freely, voluntarily and without any compulsion whatsoever -- that he was at the date thereof of sound disposing mind and memory -- that they saw Elizabeth D. Guins, Susan S. Godard and Hiram B. bloodworth sign same in presence of witnesses and testator and testator signed same in presence of all witnesses. Robert A. Whatley Franklin Godard I do solemnly swear the written paper contains the true last will and testament of Floyd Whatley deceased, and that I will well and truly execute same according to the laws of this state, to the best of my skill and ability, so help me God.
