Butts and Wiley Harper Now Therefore, This Indenture made and entered into this Twenty fourth day of March in the year of our Lord one Thousand Eight hundred and fifty five between David Dyer of the County of Morgan State of Georgia of the first part and Jacob C. Butts & Wiley Harper of the Second part. Witneseth that the said David Dyer for and in consideration of the promises and also in consideration of the Sum of Ten Dollars to him in hand paid by the said Jacob C. Butts and Wiley Harper at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained Sold and Mortgaged and by these presents doth grant, bargain Sell and Mortgage unto the Said Jacob C. Butts & Wiley Harper their heirs and assigns all of that tract or parcel of land situated lying and being in this County and State aforsaid on the water of Sandy Creek known as the Mallory Place Now by the said David Dyer containing Two hundred and Thirty acres more of less joining Thomas Harper, Gibre of that if the said David Dyer or his heirs, executor or administrators shall will and truly pay or cause to be paid unto the said Jacob C. Butts and Wiley Harper all of the said sum of money in said Bond specified according to the terms and effect thereof then and from thence fourth as well as the present Indenture shall sense be void and of no effect any thing herein contained to the contrary notwithstanding In Witness Whereof the said David Dyer hath hereunto set his hand and seal this 24th day of March in the year of our Lord one Thousand Eight hundred & fifty five Signed, Sealed and Delivered in presence of J.
