Harper Johnson clhjohnson@aol.com ==================================================================== State of Georgia} This indenture made the fifteenth day of April in the year of our Lord, one hundred eight hundred & nine between William Peterson Harper of the county of Morgan in the State aforesaid of the one part and Benjamin Ingram Harper of the same State and County of Hancock of the other part. Witnefseth that the said William Peterson Harper for and in consideration of the sum of five hundred dollars lawful and current money of said State to him in hand paid at and before the sealing and activity of these presents by the said Banjamin Ingram Harper the receipt whereof is hereby acknowledged, hath granted, bargained and sold and by these presents doth grant, bargain and sell unto the said Benjamin Ingram Harper his heirs, executors, administrators and afsigns the following property land one certain tract or parcel of land containing one hundred one and one fourth acres, situate lying and being in the nineteenth district of Baldwin County at the time it was granted now the County of Morgan, being the half of lot number seventy in the said nineteenth district of Baldwin County now the County of Morgan and the half on which the said Peterson Harper now lives, one sorrel horse about four years old, two feather beds and furniture together with all the household and kitchen furniture with the plantation utincels, two cows, one calf and one yearling & sixteen head of hogs with all other hogs which the said William Peterson Harper now pofsefses. To have and to hold the said tract of land containing one hundred one and one fourth acres of land as aforesaid and the aforesaid property unto the said Benjamin Ingram Harper his heirs, executors, administrators and afsigns, to the only proper use benefit and behoof of the said Benjamin Ingram Harper, his heirs, Executors, administrators and afsigns forever. Provided always and these presents are upon this exprefs condition that if the said William Peterson Harper, his executors or administrators will well and truly pay or cause to be paid unto the said Benjamin Ingram Harper, his heirs, Executors, administrators or afsigns the full sum of five hundred dollars on or before the fifteenth day of July next, with legal interest ____ ____ agreeable to the ____ and effect? Of his note per ____ date with these presents and made the aforesaid sum of five hundred dollars to them and in such case, these presents and every matter and things therein contained whatsoever determine and be ____ null and void, to all intents and purposes any thing herein contained to the contrary thereof in any way notwithstanding of ____ ____ not the said William Peterson Harper for himself, his heirs, Executors and administrators doth covenant and agree to and with the said Benjamin Ingram Harper, his heirs, Executors, administrators and afsigns that the said William Peterson Harper his heirs Executors and administrators shall will and truly pay or cause to be paid unto the said Benjamin Ingram Harper his Executors, administrators or afsigns the said sum of five hundred dollars with legal interest as aforesaid on the day herein before limited for pay whereof without any deduction, defaleation?, or abatement whatsoever. And that he, the said William Peterson Harper for himself his executors and administrators the said land and property aforesaid unto the said Benjamin Ingram Harper his heirs, executors and administrators and afsigns against him the said William Peterson Harper, his heirs, executors, administrators and afsigns and against all and any other person or persons whatsoever, shall and will warrant and forever defend by these presents. And, the said Benjamin Ingram Harper for himself his heirs, executors and administrators doth covenant, promise, grant and agree to and with the said William Peterson Harper his heirs, executors, administrators and afsigns that he shall and will immediately before the receipt of the said sum of five hundred dollars and interest as aforesaid at the day and time limited for the payment thereof deliver or cause to be delivered unto the said William Peterson Harper his heirs, executors, administrators or afsigns all the right, title, claim or interest of said land and property and which are now at the time of execution of these presents received by the said Benjamin Ingram Harper of and from the said William Peterson Harper.
