This file was contributed by: Pat Colbert pogosbill@aol.com ==================================================================== Morgan County Records Will Book D, page 215-216, November 1890 Last Will and Testament of Pheriby Dyer I Pheriby Dyer being of sound and disposing mind but feeling the uncertainty of life and wishing to dispose of my worly affairs while physically and mentally capable of doing so do make, constitute and direct this as my last will and testament. Item 1st I will and direct that my just debts be paid as soon after my death as convenient including fair and reasonable compensation for care and attention neccessary to insure my comfort and maintenance while living. Item 2nd I will and direct that whatever property and effects of any kind I own at the time of my death shall be taken charge of jointly by my two daughters to wit: Caroline Cornett and Mittie L. Heyser and sold my them in such manner and at such time as they may think best for the estate and to the interest of the legatees and in case it shall not be considered by them best to sell and settle my estate or any part thereof immediately after my death whatever money if any, shall come into the hands of my two daughters from my estate shall be equally divided between the four within legatees, share and share alike as soon after received as (possible?). Item 3rd I will and devise that the proceeds of all my property, real and person and mixed by divided into four equal parts, one part to my Daughter Susan Knox , one part to my Daughter Mittie L. Heyser and one part to my Grandson Robert Trapp. Item 4th I hereby authorize and direct my two daughters Caroline Cornette and Mittie L. Heyser to take charge of my property and effects and to execute the provisions of this my last will and testament. Pheriby (X )Dyer Jns. W. Butney Wm. A. Broughton U. C. Pennington W. P of Morgan County Who are herby called upon and requested to witness the signatures of myself, the said Pherby Dyar and of each other this day of May 1890 I, U.C. Pennington do swear that I, as well as Jno W. Burney and Wm A. Boughton saw the within named Pheriby Dyar sign and publish the within paper as her last will and testament that I subscribed the same as a witness thereto at the special instrument request of the said Pheriby Dyer in her presense as did also, John W,. Burney and Wm A. Broughton., she signing in our presence that the said Pheriby Dyar signed the same freely and coluntarily and was at the time of such signing of sound and disposing mind & memory.
