Item 1. It is my will & desire all my just debts be first paid out of any money or produce I may be possessed of at the time of my death or out of the sales of such part of my stock of horses, hogs, & cattle as my executors may think most proper to dispose of for that purpose. 2nd. I give to my beloved daughter Margared HEAD all my lands, negroes, stock of horses, hogs, & cattle, with all my household & kitchen furniture with all other property of every description not herein disposed of which I may be possessed of or entitled to at the time of my death provided my daughter Margaret HEAD shall well & truly obtain a bill of divorcement from her present husband BENJAMIN HEAD according to the laws of this state. Benjamin Head having left her & a numerous family of children without the means of support but in the event of my daughter Margared Head failing to sue for a divorce according to law or failing to obtain a divorce on the event of a suit or suits then it is my will all my property of every desciption shall be held by my executors in trust for the children of my daughter Margared Head & they do appropriate the profits of my estate as afsd. annually to the support & maintenance of my daughter & her children during the natural life of my daughter & during the minority of her children & if my daughter should live until all her children shall obtain to the lawful age of 21 years then my executors are at liberty to divide the profits over & above what is necessary for the mainenance & support of my daughter at their own discretion among my grandchildren share & share alike & after the death of my daughter Margaret should she fail to obtain a divorce from her husband it is my will & desire that all my property be then equally divided among my grandchildren share & share alike. But if my daughter shall truly obtain a divorce from her husband Benjamin Head according to the laws of this state it is then my will & desire my executors immediately pay & deliver over to her the whole of my estate contained and described in the first section of this my will. But under no consideration other that that of my daughter obtaining a bill of divorcement from her husband Benjamin Head is any right or title to any part of estate to be vested in her other than the annual profits for her & her childrens support. 3rd. It is my will & desire my executors keep all my negroes, stock of horses, hogs, & cattle on the plantation without a sale of anything. If my daughter should fail to get a divorce from her husband Benjamin Head except their estimation any or either of the stocks shall have so increased as to be bothersome & unnecessary & if such increase should happen it is my desire my executors advertise a sale of such property 10 days at three public places in said county & sell same at public outcry to the highest bidder on such a credit as will in their opinon be most likely to procure a fair price & the money arising from the sales of such property to be put to interest unless it may be actually necessary for maintenance & support of my daughter & her children. 4th. It is my wish & desire my executors allow my grandchildren with my daughter to live in my dwelling house with privilege of kitchen & outhouses from year to year so long as they may deem it prudent & safe to do so & also furnish them with any or all of the negroes to hold from year to year at the discretion of my executors provided my daughter is not divorced from her husband but in the event of her obtaining a bill of divorcement I desire my executors immediately thereafter to deliver over all my estate to her as her own but on no other terms are they to do so. 5th.
