Jones, of said county and state being of sound mind and disposing memory, do make, publish, and declare this my last will and testament, and hereby revoking all others by me heretofore made: Item 1st: It is my wish that my lot in the City of Madison Cemetery, upon which my mounment stands, be enclosed with granite in a good stile, Item 2nd: I give to the Court of Ordinary of said County of Morgan five shares of my Atlanta and West Point Rail Road stock, the income and dividens of which are to be used by said court in keeping up and beautifying my said lot situated in said City of Madison Cemetery. Item 3rd: I give to Jack Harrison and Elenor,his wife formerly my slaves, the sum of of five hundred dollars, to be invested by my executors in a home for them, and investing the title to said home in them, the said Jack and Eleanor, Item 4th: I will, bequeath, and devise to my former slaves Martha, wife of Wyatt Jones, and Aaron Jones, each, fifty acres of land to be taken from my "Harris Place;" and I also will and bequeath to my former slave, Albert Randolph, fifty acres of land to be off of my "Harris Place" as my executors may think best. Item 5th: I give to my son, Elijah C. Jones, all my household and kitchen furniture, my wearing apparel, my gold watch, my fire arms, my gold headed cane, my library, and all my silver ware of every kind and___ baskets about my house. Item 6th: I will, bequeath, and devise to my son, Elijah C. Jones, my house and lot in the City of Madison for and during his natural life, and at his death, to go to and vest in my grand daughter Virginia A. Jones, daughter of said Elijah C. Jones. Item 7th: I wlll and bequeath to Mrs. Jane L. Curr [?] for and during her natural life ten sahres of my "Atlanta and West Point" rail road stock, to revert to my estate at her death. I do this on account of her kindness to my grand children. Item 8th: My will and desire is that the ballance of my estate of every kind whatever, not herein or otherwise disposed of, be devided between the persons hereinafter named and in the manner hereeinater let forth, that is to say, I will, bequeath, and devise one fourth of the residue of my estate to my son, Elijah C. Jones, I will bequeath, and devise one fourth of said residue of my estate to the children of my deceased daughter, Georgia M. Mann, I bequeath, and devise, one fourth of said residue of my estate to the children of my deceased daughter, Florine C. Harris, I also will bequeath and devise one fourth part of said residue of my estate to Elijah Jones Moultrie, Louisa Wingfield Moultrie, William G. Reid, Bessie J. Napier, and Jane L.Napier, chldren of my deceased daughter, Mary. Subject to the limitations and conditions hereinafter named, viz, I do ordain and direct that the interest which may be going to William G. Reid under this Item of my will, be taken charge of by my son, Elijah C. Jones, to be held and managed by him as turstee for said William G. Reid and his children, born and to be born as long as the said William G. shall live and at his death to be equally divided between said children share and share alike. I do further will and direct that in ascertaining the interest of the said Bessie J. Naier in said on fourth of my estate that she is to receive nothing until she accounts in said division for the principal, interest, and costs paid by me under a decree of Morgan Superior Court, rendered at its March Term, in 1876, in the caseof Briggs H. Napier and wife Dr. Elijah E. Jones with interest thereon and I do further will and direct that in ascertaining the interest of said Jane L. Napier, in said one fourth part of my estate, she do account for the amount paid her and her husband George L. Napier, in final settlement with them of account of my having been her guardian--lay the sum of two thousand dollars with interes thereon from the day of payment and I do further will and devise that whatever may be going to said Bessie J. and Jane L. Napier, under this item of my will be to them and their children in trust to be disposed of by them, the said Bessie and Jane, by willl, and to be paid by my executors only to such trustees as may be appointed by the proper court having jurisdiction in the premises. Item 9th: My will and desire is that if any of the persons specifically mentined in the preceding Item as my grand children or who may be included in either set of grandchildren, should die before this will takes effect, leaving a child or children, then such child or children should take his or his place in the distributions. Item 10th: That there may be no misconstruction of the 8th Item of this my will, I will here state that my intention and meaning is that the residue of my estate mentioned in said eighth Item be divided into four equal parts--one fourth going to the person or classes of persons wherein designated and taking the interest--therein specified and subject to the limitations and conditions therein imposed both as to the character of estate taken by them and the mode of ascrtaining their respective interest or shares. I do hereby injoin it unpon my executors, if my friend Augustus Reese should then be in life at the time of my death, to employ his and their counsellor and adviser in the management of my estate and to follow advice in relation thereto, Item 11th: I do hereby constitute and appoint my son Elijah C. Jones, and my two grand sons, Reubin Elijah Mann and Elijah J. Moultrie my executors to carry out this my last will and testament. In testimony whereof I hereto let my hand affixed my seal this thirteenth Day of October 1876. Elijah E. Jones as his last will and testament whom we saw sign his name thereto and at whose specific instance and request signed our names as witnesses thereto in the presence of the testator and in the presence of each other,the said Elijah E. Jones signing the same in our presence. This the thirtieth day of Cotober, 1876. The words "one hundred" erased and fifty and "fifty" interlined in the fourth Item before signing. Samuel A. Burney, Lucius T Penick, and Henry W. Baldwin and biing regulary sworn depose, that they saw said Elijah E. Jones sign and publish the within as his last will and testament while of sound mind and disposing mind that they witnessed the same for him at his request in his presence and of each other and that the same was executed voluntarly by him the day if purportes, to have been executed, sworn to, subscribe before me in open court, November term, 1876.
