Item_ I give devise and bequeath to my wife Elizabeth A. Mann the following named property and estates as hereinafter described, to wit, negroes Jack, Grene, Tim, Old Eli, Augustus, little Jim, Matilda, Eliza, Emily, Caroline, Catherine___My carriage, carriage horses, and harnesses__four good work mules or horses__The seventh part of my stock of cattle, hogs, and sheep__also five hundred acres of land, more or less on my plantation on little Indian Creek in said County, and bounded as follows Viz, commencing on the upper Eatonton road where my lands corner with the lands belonging to the estate of Peter W. Walton dec, and running as said road now runs until it strikes my Mill Pond on Little Indian Creek__thence up said Creek until it strikes the line between me and John B. Walker__thence along said line to where my lands again corner with the lands belonging to the estate of said Walton__thence a long said line between me and said estate lands to beginning corner__also one hundred and five acres of land more or less, situated in said county on the lower Eatonton road, adjoining lands of David Dyer, James T. Finnie [could be Tinnie] and others___ also my house and lot in town of Madison upon which I now reside, together with all my household and kitchen furniture--to have and to hold the said property and estate for her use and enjoyment for the term of her natural life only. And I will and declare that said property and estate, at the death of my said wife shall vest in, and be divided among my six children. Item__I give to my said wife to and for her own proper use absolutely forever the sum of Seven Thousand dollars in cash__to be paid to her out of my estate, by my executors. Item__I give to my sister Virginia Snellings two negroes, to wit, Big Jim, and Jince__To have and to hold the same during her natural life, and at her death to vest in and be divided between my six children. Item__The balance of my estate, I give, bequeath, and devise to my six children to be divided equally between them. Item__All and every interest which my daughter Frances A. Evans and her husband John P. Evans would or may have had in any division under and by virture of any clause of this my last will and Testament in which a division among my children is contemplated, whether it be land, negroes, notes, stock, money, or any other kind of property, I do hereby give, convey, bequeath, and devise to my son Reuben J. Mann in trust for the sole and separate use, benefit, and behoof of my said daughter and her children born and to be born__to hold in trust as aforesaid until the death of my said daughter, at which time it shall vest absolutely in her said children share and share alike__and I further will and declare that the hire outs, issues, and profits of whatever kind, arising from whatever may be received by my said son Reuben J. Mann by virture of this item of my will, as well as the corpus of said trust estate, shall under no circumstances be subject to, or liable for the debts, contract or engagments of the presnet or any future husband of my said daughter Frances A. Evans. Item__I nominate and appoint my son John T. Mann to be my executor to carry out this my last will and testament. Burnett M.A. Pharr Georgia Morgan County Personally appeared in ___ Court at September Term 1850 of Inferior Court when sitting for Ordinary Purposes, Augustus Reese, William M. Burnett and Marcus A. Pharr___the subscribing witnesses to the ____ insturment in writing purporting to be the last will and testament of Reuben Mann late of this county deceased, who being duly sworn saith that they saw the testator sign seal and deliver the same as such, and that they believe he was of sound disposing mind and memory at the time, and that they subscribed to the same as witness in his presence and in the presence of each other. Note caption under the N.R. BENNETT HOUSE "...Known as the house that changed a law. When this fine old house was gambled away by a reckless husband, the Georgia law was changed in 1866, which at one time gave a woman's property to her husband upon marriage. This was formerly the Mann, Hilsman, Lawrence home." Mann (no given name) appears to have been the first owner. After reading the will of Reuben Mann one would wonder if it was his son-in-law who lost this house gambling even though Reuben made his will 16-17 years earlier.
