As it is appointed unto men once to die and as it is uncertain when the decree will go forth and also as it is important in order to avoid protracted and costly law suits for every testator to make known his will in due time I deem it important for me whilst in a State of bodily affliction but sound mind to make this my last Will and testament in which I will 1st My wife Nancy shall be my Executrix without giving security for the discharge of her duties as such and for her to have full power to discharge my Estate consisting of real personal and perishable property according to her Judgment with the restrictions hereinafter prescribed. 1st I will that she pay all my just debts. 2nd Secondly that she keep the family both black and white together and to maintain them out of the general Acct. 3rd Thirdly that she board clothe and educate each of my children out of the joint stock until they shall become of age or marry in the event of which she shall give each one one thousand dollars in money or the same amount in property according to valuation. 4th Fourthly that she retain the balance of the Estate in her hands to manage according to her will until she marries or during her natural life. If the she marries she shall share with the children as above stated and the remainder shall be turned over into the hands of my son Robert who shall act in such a care as Executor by giving Security for the performance Executor, but if she never marries after giving of the portion of money or property as above stated to each child as it may marry or become of age she may retain the balance of the Estate in her own hands untill her death when the sd. balance of the Estate shall be equally divided between the children. Personally appeared in open Court Daniel Johnson a ------- witness to the foregoing instrument in writing purporting to be the last will and Testament of Martin Puckett deceased who being duly sworn deposeth and saith that he saw the testator sign seal and deliver the same for the purposes therein espoused and believes he was at the time of sound and disposing mind & memory and that he testifies the same as a witness. He saw Nestor Pille & John W. Pille testify the same as witnesses in his presence.
