Snellings of said county and being of sound and disposing mind and memory, but realizing the uncertainty of life and deeming it best for the interest of my family for me so to do,do make and ordain, publish and declare this to be my last will and testament, hereby revoking any and all wills by me heretofore made. Item 1 I desire and direct my Executors--herein after named to pay all of my just debts as soon as practicable after my death. Item 2 It is my will and desire that my property be kept together and controled by my Executors for the benefit of my wife, Nancy A. Snellings, and my children born to me by my said wife, not including those by my former marriage, until my youngest child arrives at age, unless my said wife should depart this life before that time and the proceeds of said property to be used for the support, maintenance, and eduction of my children, and for support of my said wife, and should there be a surplus at any time over and above what is necessary for said purposes it is my will and desire that my Executors invest, lend out, or use as it their judgement will be for the interest of my estate, said surplus, and upon my youngest child arriving at age twenty one, or when death of my wife, it is my will and desire that all of my property except my land be sold and the proceeds be equally divided share and share alike between my wife Nancy A. Snellings and my children Ines D. Toler, Madison A. Snellings, Fanny M. Snellings, Antonette Snellings, Mary E. Snellings,and John A.Snellings. Should my said wife depart this life before the sale and division directed in this item, then all of proceeds of said sale are to be eually divided between my children herein above named. Item 3 Should my Executors at anytime deem it expedient, or for the best interest of my estate to sell any surplus stock or other personal property, they are hereby authorized to sell the same at private or public sale as they may think best without applying for or obtaining leave from ordinary or any court. Item 4 I will and devise to my beloved wife during her life the place on which I now live, including all the lands and improvements thereon, and at her death I disire and direct the same to be sold and proceeds to be disposed of and divided to each of my grand children, Miller Allen, Lessy Allen, Foster Allen, and Burness Allen, children of my daughter Virginia Allen, the sum of fifty dollars. To my grandson Willlie A. McDougal, child of my daughter Sarah Ann McDougal, the sum of fifty dollars, and all the balance of said proceeds, I will and desire to be equally divided, share and sahre alike, between my chldren Inez D. Toler, Madison A. Snellings, Fanny M. Snellings, Antoinette Snellings, and John A. Snellings. Item 8 I hereby nominate and appoint my wife Nancy A. Snellings Executrix, and my friend Judge K. Nolan, and my son Madison A. Snellings Executors of this my last will and testament. Signed, sealed, published, and declared to the my last will and teatament in presence of the undersigned Witnesses, who at his request in the presence, and in the presence of each other signed the same as witnesses. Brobston Additional Comments: Madison Branch Snellings was born 1810 in Rehobathville, Morgan County, Georgia to Alexander and Virginia(Mann) Snellings. Alexander and Virginia arrived in Morgan County in 1808 from Chesterfield County, Virginia. He married Mary Hicks in 1838 and after her death married Nancy A. McIntosh, daughter of Daniel and Sarah (Cartwright) McIntosh in 1851. He had provided for the children of his first marriage before his Marriage to Nancy McIntosh. Daughters by Nancy A. (McIntosh) Snellings: Inez D. Snellings married William Augustus Toler and lived in Madison , Georgia. Frances "Fanny" Snellings married Joel Mack Hansford and lived in Rutledge, Athens, and Atlanta, Georgia. Antoinette Snellings married George Bearden and lived in Madison,Georgia. Mary Snellings married Henry Hale and lived in Morgan County, Georgia.
