Pg. 138-139 The State of Georgia ) Muscogee County ) Know all men by these presents that we C.C. Cody and Mrs. Maria L. Cody,his wife of the County and State aforesaid for and in consideration of the sum of Three Thousand Dollars to us in hand paid by John S. Colbert Trustee for Mrs. Emily F. Colbert his wife of said County and State the receipt whereof we do hereby acknowledge do hereby grant, bargain and sell to the said John S. Colbert as trustee for his wife aforesaid the following described lands to wit: The North west quarter and the North west quarter of the South West quarter and the South west quarter of the Southwest quarter, all in Section Number five (5) and the North east quarter of the North east quarter and the North west quarter of the North east quarter and the South west quarter of the North east quarter and the North East quarter of the South East quarter. And the North West quarter of the South East quarter And the South East quarter of the South East quarter of Section Number 6 and the Northeast quarter of the North East of section seven. And the North West quarter of the North West quarter of Section eight (8) all in township Twelve (12) of Range Twenty five (25) also seven and a quarter acres on the South East corner of the South West quarter of Section thirty Two (32), in Township Thirteen (13), of Range Twenty five (25) all lying and being in the District of lands subject to sale at Montgomery and located apart in formerly Barbour but now Bullock and a part in Pike County in the State of Alabama. To have and to hold the aforegranted premises to the said John S. Colbert as a trustee aforesaid under the trusts and conditions hereinafter aforesaid and to his successors in trust and their assigns to their use forever in fee simple. In trust however for the sole use and benefit of said Mrs. Emily F. Colbert wife of the said John S. Colbert and their children born and to be born and to be born in the sole and separate estate free and discharged and not in any way to be made liable for the debts or interest of her present or any future husband for and during her natural life. In trust and for life she and trustee and his successor in trust shall permit the said Mrs. Emily F. Colbert to have the use in the said profits of the said trust estate for the support of herself and family without accounting for the same as their sole and separate estate and not to be liable for the debts of her husband. In trust further that the said Trustee and his successors in trust and the said Mrs Emily F. Colbert shall have the power and authority to sell and dispose of the said trusts estate or any part thereof and their conveyance thereof shall vest in the purchaser a good and valid title to the same and the said trustee and his successors in trust shall have the power and authority to reinvest the proceeds coming from the sale of the land or any other property either real or personal which may be better suited to the condition and circumstances of the said Mrs. E.F. Colbert and her family taking deeds for the same with all the trusts conditions and considerations herein specified. In trust further that the said Mrs E. F. Colbert shall have the power and authority to change said trustee or any successor in trust and may make said appointmentin writing, when the acting trustee shall convey said trust estate and the execution of the trust herein specified and the person appointed by her as aforesaid shall exercise all the power hereby vested in said original trustee. In trust further that upon the death of the said Mrs Emily F. Colbert the said trust estate of whatsoever it may consist shall go to and be equally divided between the children of the said John S. Colbert and his wife Mrs E.F. Colbert who may be living at the time of her death. To have and to hold to them their heirs and assigns forever. In testimony whereof the said C.C. Cody and Mrs M.L. Cody his wife have hereto set their hands and seals on this the 13th day of January in the year 1869. Columbus C. Cody (Seal) Maria L. Cody (Seal) The State of Georgia ) Muscogee County ) I, Wiley Williams commissioner appointed by the Governor of the State of Alabama and qualified to take proof and acknowledgments of deeds executed in this State conveying lands lying and being in the State of Alabama certify that C.C. Cody and Mrs M.L. Cody whose names are assigned to the within Deed and who are known to me acknowledged before me on this day that being informed of the contents of said they voluntarily executed the same on this day of its date.
