A. Nix, Edgar C. Nix, B. G. Nix, J. W. Nix, Mrs. W. M. Taff, Cora J. Nix, Mrs. E. M. Howell, Jerry Nix, Edwin C. Nix. Whereas, W. A. Nix died of December 1, 1913 intestate and leaving an estate consisting of realty and personalty in Muscogee County, Georgia and as his heirs at law his widow, Mrs. M. E. Nix, and nine children, to-wit: Jerry Nix and E. C. Nix of Denison, Texas; J. W. Nix, Mrs. W. M. Taff, Cora J. Nix, Mrs. E. M. Howell and B. G. Nix of Muscogee County, Georgia; and E. C. Nix and R. A. Nix of Bibb County, Georgia; and Whereas the said W. A. Nix was at the time of his death indebted to R. A. Nix in the sum of One Hundred ($100.00) Dollars, E. C. Nix in the sum of One Hundred ($100.00) Dollars, and B. G. Nix in the sum of Sixty ($60.00) Dollars, and Whereas it is the desire of all of the heirs at law of the said W. A. Nix that the said widow, Mrs. M. E. Nix, do take possession of and control of all of the real estate owned by the said W. A. Nix at the time of his death and have the rents, issues and profits thereof for and during her natural life, and Whereas it is the desire of all of the heirs at law of the said W. A. Nix that said indebtedness be fully paid off and said estate be administered by agreement between all of the parties without formally taking administration on said estate before the Ordinary of Muscogee County, Georgia. Now therefore, the premises considered and in consideration of the mutual premises and obligations each to the others between and among several heirs at laws of the said W. A. Nix, it is ordered, stated and agreed by and between them that the said Mrs. M. E. Nix shall have, for and during her natural life, and to accomplish this purpose, each of the said parties do hereby sell, alien and convey to the said Mrs. M. E. Nix for and during her natural life all right, title, claim, interest and demand that they, and each of them, have or may have In all that tract or parcel of land situated, lying and being in Bozeman's District of Muscogee County, Georgia, containing one hundred ninety (190) acres, more or less, and bounded on the north by lands of Henry Moon and lands of Mrs. Josie Edwards, on the east by lands of Walter Kendrick and Mrs. Ogletree; on the south by lands of Zenus Britt and on the west by lands of Ennis Sturkey and Ben Sturkey, and being the same lands whereon the said W. A. Nix resided at the time of his death as foresaid. Upon the death of the said Mrs. M. E. Nix, said above described real estate shall be divided share and share alike among each fo the named children of the said W. A. Nix and Mrs. M. E. Nix. It is further agreed by and between all of said parties that the said Mrs. M. E. Nix shall sell and dispose of all of the personal property owned by the said W. A. Nix at the time of his death and apply the proceeds arising from the sale thereof to the payment of the indebtedness hereinbefore specified and should the proceeds arising from such sale be insufficient to pay off said indebtedness, then the persons aforenamed as holding such indebtedness shall have a lien upon the interests of the other heirs at law in the real estate heretofore described. The indebtedness above mentioned shall bear interest at seven percent per annum from August 4, 1913 until the same shall have been fully paid, and in the event the same is not fully paid by the proceeds arising from the sale of personal property, then said creditors may foreclose their said lien against the interests of the other heirs at law in said real estate as mortgage liens are foreclosed against real estate, any time within a period of twenty years from said fourth day of August, 1913. And the said Mrs. M. E. Nix is hereby constituted and appointed the attorney in fact for each and every one of the children of the said W. A. Nix as herein named, and as such she is fully authorized and empowered to carry into effect the agreement contained herein and execute to the purchasers of said property good and sufficient titles thereto.
