Great Uncle Robert died April 14, 1932. THE LAST WILL AND TESTAMENT OF ROBERT S. GRIER GEORGIA, MUSCOGEE COUNTY. IN THE NAME OF GOD, AMEN: I, Robert S. Grier, of said State and County, being of sound and disposing mind and memory, do make, publish and declare this as my last Will and Testament, hereby revoking any and all former wills by me at any time made. Item 1: I direct that my Executrix hereinafter named shall pay all of my just debts as soon after my death as is consistent with proper administration of my said estate. Item 2: Believing that a man’s estate should be used for the benefit of the wife and children that survive him, it is my will, and I direct that there shall be no expensive slab or monument erected over my grave. Item 3: I have caused to be issued upon my life several insurance Policies Which are made payable to my wife, and the funds arising from such policiesd are not to be subject to any conditions, limitations or charges whatever, but having the utmost confidence in my wife, it is my wish that she shall use the income from the funds accruing from such Policies of Insurance to aid in the support and maintenance of my children, together with herself. This is not a directive, but a request. I request and advise my said wife that she keep this fund intact, and that the same be properly invested so as to insure a safe revenue therefrom. Item 4: I give and bequeath to my said wife, Annie, my household and kitchen furniture, and such articles as are kept by us in the house for household purposes. Item 5: I give and bequeath to my said wife, Annie, all the rest and residue of my property, real and personal, of whatever character, for and during the term of her natural life, or during her widowhood. Upon her death or re-marriage all of the property herein bequeathed to her for life shall go to my children, share and share alike, in fee simple. If any of my said children shall marry or die before the death of my said wife and shall leave a child or children surviving, the share of such deceased child shall be divided equally between his or her children; but is either of my said children should marry and die withi\out child or children, then the interest of such child shall vest in the other surviving children. Item 6: From the income of my said estate during the life or widowhood of my said wife, my children are to be supported and educated, and the life estate is charged with such support and maintenance. Item 7: I further direct that if my mother, Maria Grier, shall survive me that my said wife shall, from the income of my said estate, take care of and support her and see that she does not suffer nor want either, comfort, food, or clothing. This is likewise made a charge upon the life estate of my said wife. Item 8: I further direct that if the income from said estate during the life or widowhood of my said wife shall not be sufficient at any time to properly support and maintain my said wife and children, then my said wife has the authority and is instructed to sell a part of my said real estate or personal property as to her may seem best to meet such contingencies, and her deed to the purchaser of such property shall serve to convey the fee simple title to the property sold. I charge and direct my said wife, however, to exercise this power with due regard to the rights of our children and after mature deliberation. Item 9: Should the income from my estate, which I desire to be kept together as far as practicable, be more than sufficient to properly support and maintain my said wife and children, I direct that the surplus shall be safeguarded until a sufficient amount is accumulated to be invested in real estate, and my wife is directed to so invest the same. The real estate purchased shall pass under the terms of this Will to my children as directed in Item 5 above, upon the death of my said wife. Item 10: I constitute and appoint my said wife, Annie F. Grier, as the sole executrix of this, my said Will, and I do hereby relieve her from giving bond as such, or of making any returns to any Court of her acts as such executrix. Robert S. Grier Signed, declared and published by Robert S. Grier as his last Will and Testament in the presence of us, the subscribers who subscribe our names hereto in the presence of said testor at his instance and request, and in the presence of each other, he signed in our presence as we signing in his presence and in the presence of each other.
