MATILDA GRIER HALL GEORGIA, MUSCOGEE COUNTY. I, MRS. MATILDA GRIER HALL, of said State and County, being of sound and disposing mind and memory and realizing the certainty of death and the uncertainty of life, do make, declare and publish this as my Last Will and Testament, hereby revoking and annulling any and all other wills by me heretofore made. ITEM ONE. I desire that my soul be committed into the hands of Almighty God and that my body be buried in a Christian-like manner, suitable to my circumstances and condition in life, details which I leave to my Executor, hereinafter, named. ITEM TWO. I desire that all my just and honest debts be paid as soon as practical after my death, consistent with the best interest of my estate. ITEM THREE. I give and bequeath to the Pastor of the Church of the Holy Family, Columbus, Georgia, the sum of Four Hundred Dollars ($400.00), to be used as follows: One-half (1/2) of the said sum to be used for the operation and maintenance of the Church’s School in Muscogee County, Georgia, One-half (1/2) of the said sum to be used for the operation and maintenance of the said Church and its projects in Muscogee County, Georgia. The said Executor, upon delivery of the said bequest to the said Pastor and taking a receipt therefore from the said Pastor, shall be forevr relieved from all liability and responsibility as to the bequest to said Pastor. ITEM FOUR I give, bequeath and devise one- sixth (1/6) of all the rest, remainder and residue of my property and estate of every kind and character, real, personal, tangible, intangible, mixed and otherwise, wheresoever located, to Mrs. Oleta F. Hall, Joseph Hall, Jane Hall, and Mary Ann Hall, the widow and children of my deceased son, Jpseph Hall, to be theirs, share and share alike, absolutely in Fee Simple. ITEM FIVE I give, bequeath and devise five-sixths (5/6) of all the rest, remainder and residue of my property and estate of every kind and character, real, personal, fangible, intangible, mixed and otherwise, wheresoever located, to my children now living, namely, Mrs. Hazel McKnight Curl, Mrs. Winifred McKnight Barr, Mrs. Irma McKnight Jordan, Robert B. McKnight and Howard E. Hall, Jr., to be theirs, share and share alike, absolutely in Fee Simple. Should any one of my said children named in this Item of my Will predecease me and leave children, including adopted children, surviving them, then in that event the share that would have gone to the deceased one shall go to his/her children (my grandchildren) per stirpes and not per capita, absolutely and in Fee Simple. Should any one of my said children named in this Item of my Will, predecease me and leave no children, including adopted children, surviving, then and in that event, the share that would have gone to the deceased one shall go to my other children living at the time of my death, to be theirs, share and share alike, absolutely in Fee Simple. ITEM SIX In the event that any of the legatees under this Will are minors at the time that my Executor is ready to make distribution of my property and estate, pursuant to the provisions of this my Will, said Executor shall deliver and surrender the bequest, devises and legacies or distributive share due the said minor or minors to the living parent of said minors. If there is not a living parent of the said minors, then and in that event a legal guardian shall be appointed and qualified for said minor or minors before the said Executor shall deliver and surrender the bequests, devices, and legacies or distributive share due the said minor or minors having no living parent. A receipt from the living parent/parents of the said minor or minors or from the duly qualified and acting guardian, as the case may be, shall relieve the said Executor from any further liability or resposibliity for the use and preservation of the bequests, devises, legacies and distributive share to the said minor or minors under this Will. ITEM SEVEN. I hereby nominate and appoint as Executor of this my Will, my said son, Howard E. Hall, Jr., and I hereby expressly relieve my said Executor from making any inventory of my estate, of having an appraisement made, from giving bond and from making any return to any Court or Courts of his acts and doings, and he is only required to probate this my Will. I hereby confer upon my said Executor full and ample power to administer my estate, and to this end he is authorized to sell any part of my estate for distribution, liquidation and payment of debts, with or without order of the Court, with or without advertisement, at public or private sale, as he may deem best, at whatever price and on whatever terms he deems sufficient, and to execute and deliver deeds of conveyance or bills of sale or transfers and assignments, as the case may be, to any purchaser or purchasers, in as full and ample a manner as I, myself, could do, were I still in life. IN TESTIMONY THEREOF, I have hereunto set my hand and seal, this the 15th day of December, 1955, in Columbus, Georgia.  Signed, sealed, declared and published by Mrs. Matilda Grier Hall as her Last Will and Testament, in the presence of us, the undersigned witnesses, she first signing in our presence, and we, then, at her special insistence and request, signing in her presence, and all signing in the presence of each other.
