State of Georgia Catoosa County: I Kenneth MacKenzie of the city of Columbus, County of Muscogee and State aforesaid being in advanced age & feeble health do make and ordain this my last will and testament. Item 1st. I bequeath my soul to God who gave it in humble trust & confidence that he will receive it not for any merit or righteousness of my own but for the righteousness of his Son Jesus Christ. Item 2nd. I will and bequeath to James C. Patterson of Lawrence, Georgia to held in trust for the use and benefit of the parties hereafter named the amount of Twenty Six Thousand Dollars in the Bonds of the following companies to wit Bonds of the State of Georgia, Bonds of the City Council of Augusta, Bonds of the LaGrange & West Point Rail Road Company and Bonds of the Macon & South Western, Rail Road Company. The conditions of the above mentioned trust shall be as follows to wit: The amount of Twenty Six Thousand Dollars in bonds as a foresaid shall be chargeable as a friend with payment of One Hundred Pounds Sterling annually to the following named parties in the manner following Forty five Pounds Sterling to paid annually to James Tullock & May, his wife during the natural lives and in the event of the death of one or the other of said last mentioned parties then one half of said amount only shall be paid to the survivor during his or her life and the amount or sum of Thirty five Pounds Sterling shall be paid to my beloved brother Rory McKinzie annually for & during the term of his natural life and the sum of Twenty Pounds Sterling shall be paid annually to my niece Janett Tullock for and the term of her natural life and I will and ordain that subject to the payment of the amount of One Hundred Pound Sterling annually in the manner above specified all the remaining right title & interest in and to said amount of Twenty Six Thousand Dollars as a foresaid shall vest absolutely in my two beloved nephews William Tullock & Kenneth Tullock & in my beloved niece Janett Tullock in shares and proportions as follows to wit: to each of my aforesaid nephews Eight Thousand Dollars and to my niece Ten Thousand Dollars to have and hold the same for their own use benefit & behoove forever and I further will and ordain that said James C. Patterson as trustee shall select said amount of Twenty Six Thousand Dollars out of any bonds now in his possession on either of the above specified Companies at his own discretion and I further will and ordain that said James C. Patterson shall receive for his services as trustee __the sum of one hundred & fifty dollars per annum. Item 3rd. I give and bequeath to the children begotten of the body of my beloved niece Sophia McBride and also the children begotten of the body of my beloved niece Janett Bain, the amount as same above specified and I will and ordain that the amount herein bequeathed the children of said Janett Bain shall be chargeable as a fund with the support and maintenance of said Janett Bain and her present husband during their natural lives and I further will and ordain that the amount bequeathed to the children of my niece Sophia McBride shall be kept free from the control management or guardianship of the present husband of said last mentioned niece or any future husband she may have. Item 4th I give & bequeaths to James Tullock & May his wife Forty five Pounds Sterling to be paid annually during their natural lives out the fund and in the manner specified in the 2nd Item of this will. Item 5th I give and bequeaths to my beloved brother Rory MacKenzie Thirty five Pounds Sterling per annum during the term of his natural life & as specified in Item 2nd. Item 6th I give and bequeaths to Janett Tullock Twenty Pounds Sterling to be paid annually in the manner & out of the fund specified in Item 2nd. of this will during the term of his natural life. Item 7th. I give and bequeath to my beloved nephews William Tullock and Kenneth Tullock and my niece Janett Tullock the sum of Twenty Six Thousand Dollars as specified in Item 2nd. Subject to the conditions therein mentioned for their own use benefit & behoove forever. Item 8th. I give and bequeath to Richard Burt of Columbus Georgia the amount of One Thousand Dollars in Bonds of the State of Georgia bearing interest at six per cent. Item 9th. I give and bequeath all my wearing apparel to my a foresaid nephews William Tullock & Kenneth Tullock. Item 10th. I give & bequeath to John Bain husband of niece Janett Bain the tract of land on which he now resides. Item 11th. I acquit and discharge Dav_____________of a judgment debt he owes me of between Four & Five Hundred Dollars. Item 12th. I acquit and discharge Calvin Stratton of a debt he owes me of some Two hundred or Two Hundred and Fifty Dollars. Item 13th. I appoint Dr. Robert A. ____guardian of my kind and faithful servant Miles and vest in him the legal title to said boy in full confidence that will carry out my wishes in regard to said boy and r______ him for his kindness to me. Item 14th. The whole residue of my estate whether consisting of real or personal property including all my good chattels rights & credits debts due me by bond simple contract debt and debts due on open accounts not disposed of in any of the former bequests in this my last will & testament shall be as a fund first chargeable with the payment of all my just debts after which the remainder shall be divided into three equal share _______________________________________of Columbus to be laid out and extended by the amelioration of the condition of the poor of said city according to their discretion and another third of said residue to be given to the Female-Asylum of the said city of Columbus and the remaining one third to be given to my brother Rory McKinzie to be laid out & extended by him for the use of the poor of Scotland according to own discretion. And I hereby appoint S. T. Downing of the City of Columbus executor of this my last will and testament. In witness whereof I have hereto set my hand & affixed my seal this July 7, 1854.
