All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: John Simmons http://www.genrecords.net/emailregistry/vols/00030.html#0007486 December 22, 2022, 7:57 am Source: Muscogee County, Georgia Wills Written: February 11, 1845 Recorded: 1845 Georgia Muscogee County} This the last will and Testament of Henry Pruett of the County and State aforesaid I Henry Pruett considering the uncertainty of this mortal life and being sick in body but sound in mind and memory do make and publish this my last will and testament in answer and form as follows Item 1st It is my will that all my estate both real and personal remain in on common stock until my son John Thadeus Pruett arrives at the age of twenty years at which time it is my will that an equal division of all my property (not otherwise disposed of) take place between my beloved wife Mary A Pruett and all my children but provided my wife Mary A Pruett should die or marry before my son John Thadeus Pruett arrives at the above named age it is my will that a division of all my property take place agreeable to the above stipulated plan Item 2 I give and bequeath to my beloved wife Mary A Pruett our negro girl by the name of Harriet sixteen years of age to be and remain her property during her natural life At her death the above named negro girl together with her increase be returned to and become the property of all my children I also give my wife Mary A Pruett a negro man named Israel about eighteen years of age to remain her property during her widowhood but at her death or marriage to be returned to and become the property [of] all my children I further give to my wife Mary A Pruett an equal or childs part of all my property not herein disposed of to be by her disposed of in any manner she may think proper Item 3 I give and bequeath to my son William Rees Pruett a sufficient quantity of money to purchase him a negro boy about eighteen years of age said boy to be purchased by my by my executors for which boy he shall be charged six hundred dollars the money to purchase said boy to be raised out of the proceeds of my present crop and out of debts due me I also give my son William Reese Pruett one grey mare saddle bridle which he has many in his possession I also give to said son one bed bedstead +furniture the above described property is valued by me at one hundred and forty seven 50/100 dollars as my memorandum book will show. It is my will that my above named son have his portion including the above described property in money and property at a fair reduction to the amount of Eleven Hundred and thirty two dollars. Item 4th I give and bequeath to my daughter Eliza Anne Fortson one negro girl or woman named Lucinda and her three children (viz) George Gracy + Jane together with her other increase which negroes she has now in possession and are by me valued at the sum of one thousand dollars and other property amounting in all to Eleven Hundred and thirty two dollars as my memorandum book will so show Item 5th I give and bequeath to my daughter Ariadna Hampton and her lawful heirs being the issue of her body one negro woman by the name of Catharine and her three children (to wit) Benjamin Mose + Israel with all other increase which negro woman and three children she now has in her possession and valued by me at one thousand dollars I having given her property amounting in all to eleven hundred and thirty two dollars as my memorandum book will show Item 6th I give and bequeath to my son Jacob Henry Pruett one negro by the name of Bill thirteen years old which negro boy I value at the sum of six hundred dollars It is my desire that money and other property be given him at a fair valuation sufficient to make his portion amount be eleven hundred and thirty two dollars Item 7th I give and bequeath to my son John Thadeus Pruett one negro boy by the name of Alfred ten years of age which negro boy I value at the sum of six hundred dollars It is my will that he have – money and other property given to him sufficient to make his share amount to Eleven hundred + thirty two dollars Item 8th I give and bequeath to my daughter Elizabeth Pruett one negro girl by the name of Lucy fourteen years of age it is my will that said negro girl with her increase be valued at prices equal to the prices set on the negroes given to my other daughters at the time said daughter shall marry or arrive at the age of eighteen years It is also my will that money and other property be given to her at a fair valuation sufficient to make her share of my estate worth Eleven hundred and thirty two dollars it is also my will that said property decend to her lawful heirs they being the issue of her body Item 9th I give and bequeath to my son Augustus Romullus Biall Pruett one negro boy by the name of Edward seven years of age which negro boy-I value at the sum of six hundred dollars It is also my will that money and property at a fair valuation be given to him sufficient to make his share worth in all Eleven hundred and thirty two dollars at the time of a division of the other property shall take place Item 10th I give and bequeath to my daughter Josephine Pruett one negro girl by the name of Martha Eleven years of age to be valued agreeable to the other negroes given to my other daughters the valuation to take place at the division of the other property it is also my desire that money & other property at a fair valuation be given to her sufficient to make her portion in all amount to Eleven hundred and thirty two dollars it is my desire that the above described property remain under her controll after marriage and shall in no case be taken to pay the debts of her husband & shall decend to her lawful heirs being the issue of her body Item 11th It is my will that provided any of the negroes given to my young or unmarried children should die before a division of my property takes place that each or other child who may lose a negro shall have another or others given as near equal in value as can be had to supply the deficiency or deficiencies that may occur It is my will that my Executors and Executrix have power to sell or purchase property whenever a majority of them may think it best for the interest of the estate Item 12th It is my will that if a division shall take place before my son Jacob H. Pruett John T Pruett Mary E Pruett before the above named children shall have received their education that in that case provisions be made for their support and education out of the estate Item 13th It is my will that Augustus Romullus Beall Pruett and Josephine Pruett receive from my Estate support and education Item 14th I do thereby constitute and appoint my wife Mary A.
