All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: John Simmons http://www.genrecords.net/emailregistry/vols/00030.html#0007486 August 28, 2019, 10:43 am Source: Georgia Probate Records, Muscogee County Written: August 15, 1840 Recorded: January 26, 1841 Georgia Muscogee County Be it known to all to whom these presents shall come that heretofore to wit on the fifteenth day of August in the year of our Lord eighteen hundred and forty William Scurlock of said county and state in his last sickness in the habitation or dwelling house of John Scurlock where he had been resident about one month made the following nuncupative will in words that is to say he the said Scurlock then and there gave and bequeathed a certain Negro Girl slave of light complexion named Rachel about seven yeas of age to his daughter Caroline Matilda Files now ( formerly Caroline Matilda Scurlock together will all her future natural increase to her and to her heirs forever. He also then and there gave and bequeathed to his beloved wife Rhoda Scurlock all the balance of his real and personal estate of whatsoever kind or nature the same may be to her and her heirs forever. Georgia Muscogee County Personally appeared in open court Benjamin Doles and John Scurlock and Gracey Scurlock who being duly sworn deposeth and saith that they were present at the last sickness of William Scurlock at the residence and dwelling house of John Scurlock in the county and state aforesaid and that he died without returning to his residence and that they heard him declare and publish in substance the above and foregoing as his last will and testament and that the said Scurlock called upon them to take notice thereof and bear witness of the same and that each were in his presence and he was at the time of sound and disposing mind and memory and that he published and declared the same freely without any compulsion so far as we know or believe Sworn to and subscribed in open court this 26th day of January eighteen hundred and forty one John Scurlock Gracey Scurlock mark Additional Comments: William Scurlock was a veteran soldier of the Revolutionary War having served in the North Carolina Militia. He had land holdings in Talbot County, Georgia. He moved from North Carolina after the Revolutionary War to Baldwin County. He filed for a pension in Baldwin in 1833. He was married to Rhoda Simmons of Wake County, North Carolina in Hancock County, Georgia in 1790.
