Ware's Will; State of Virginia, City of Richmond: In the name of God - Amen. I, James H Ware, being of sound mind and memory and knowing the changes to which I am exposed do make this my last will and testament. Item 1st: I will that my body be buried in a decent and Christian like manner. Item 2nd: It is my will that my just debts be paid by my executor hereinafter named, as soon as they can be properly accounted. Item 3rd: I will and bequeath all the property of which I may be possessed at the time of my death or to which I may hereafter be entitled to, and all property and effects owned by me in possession re???? or remainder, and all other property of which I am now or may hereafter be ???? lands and tenements rights, and credits, goods, and chattels, money, notes, class in action, and all other evidences of debt, and in general all my estate, both real and personnel unto my beloved father, Robert A. Ware, of the City of Columbus, in the State of Georgia, to him and his [trust} forever. Item 4th: I hereby nominate and appoint my father, the said Robert A. Ware, to be the executor of this my last will and testament, hereby revoking all other wills and that I may have heretofore made. I do make, publish and declare this to be my last will and testament. In witness whereof I have hereto set my hand and affixed my seal this the 15 day of November in the year of our Lord one thousand eighteen hundred and sixty-one, in the presence of the subscribing witnesses. Signed James H. Ware Additional Comments: James Henry Ware was shot from his horse at the battle of Mechanicsburg, Va. in the CSA. He died June 26, 1862, and is buried in Linwood Cemetery, Columbus, Ga.
