Lin Newton Co, Ga Deed Book C Page 398 Date 29 May 1839 This indenture made this the twenty-ninth day of May in the year of our Lord eighteen hundred and thirty nine between William Tucker of the one part and Rees H. Lin of the other part both of the County and State above written. Witnesseth that the said William Tucker hath this day made and delivered unto the said Rees H. Lin his certain promissory note subscribed with his hand and bearing even date with these presents whereby the said William Tucker hath promised to pay to the said Rees H. Lin or bearer one hundred dollars on or before the twenty fifth day of December next ensuing the date hereof for value received. Now for and in consideration of the sum of five dollars by him the said Rees H. Lin to the said William Tucker in hand paid the receipt whereof is hereby acknowledged as well as for the better securing the payment of the aforesaid promissory note the said William Tucker hath granted bargained and sold doth by these presents grant bargain and sell unto the said Rees H. Lin his heirs and assigns all that tract or parcel of land situate lying and being near Yellow River in Newton County and State aforesaid in the sixteenth district Henry County when surveyed now Newton County (No. 385) three hundred and eight five adjoining lands of George W Lester and William Rice the northeast part of said lot containing fifty acres more or less. To have and hold said bargained premises to the said Rees H. Lin his heirs and assigns to his and their own proper use benefit and behoof forever. And the said William Tucker for himself his heirs executors and administrators the said bargained premises unto the said Reese H. Lin will warrant and forever defend against the claim of himself and his heirs and against the claim of all other persons whatever. Provided nevertheless that if the said William Tucker his heirs executors and administrators shall and {do} well and timely pay or cause to be paid unto the said Rees H. Lin his heirs and his assigns the aforementioned sum of one hundred dollars on the day and time mentioned and appointed for the payment thereof in said promissory note mentioned1 with lawful interest for the same according to the {terms} of said note then and from thenceforth as well {the present} _____ and this right to the property thereby conveyed as the said promissory note ____ and determine and be void to all interests and purposes.
