Stewart, in Rocky Plains district, on May 27, 1895, was called in Newton Superior court, last week. He was placed on trial and a verdict of “voluntary manslaughter” returned by the jury. He was sentenced to serve eight years in the penitentiary. A motion for a new trial was filed, on several grounds. His son, Sanders McDaniel was tried last year and a like verdict rendered, and he is now serving a sentence of twelve years in the penitentiary, being at present at the camp of Messrs. Bagby & Speer, which is located three miles south of Covington. The difficulty which lead to the death of Mr. Stewart was caused about the land lines between the places of the parties, the McDaniel’s claiming that Stewart had built a wire fence on part of their land, while Stewart insisted that the fence was on the legal line, or rather upon his own land.
